yeeterday on a motion to lay the bill to lay

nemieu. The subjeot was taken up soon ef.

without sotpensiOa till three o'clock in

Otay aay with truth, that although we could

manner in which Wa contended for it. The
debate occurred on a substitute to the origi
■el hill, in which acme trilling amendment!
had bean made, by those who drew the latter.
• Those who opposed the bill were MeaSrs.
Turner, Lumpkin, Baker ef Warren,
end Dougherty—those who supported it were
Merer*. Burnside, Holsey and Pollhill. The
'arguments used against the bill were that it
- Was not called for by the people—that the
State was out yet Completely organized—
that it would divide our representation in
Congress, when union wee necessary—that
Bo uvils bad been pointed ont in An present
mofin of election—that it would 'open the
door to intrigue—that under the present aya-
tem candidates were elected by weight of
'character—aed it was argued against the bill
itself, that it waa defective in the arrangement
of tba counties, Ac. fire. The advocates of
the bill coneludeded that the District system
was adopted in most of the states—that it
was ths most Republics o in Its character, by
•tabling the people to know those whom
they elect—that too greet a number of Re-
preaentatives is Congress war# sow fro-
queotly elected from the earn*' section of
country, Ac. Ac. The debate will be return-
od today, when most likely sdeoiiton will
be mafic. The friends end opponents of the
•assure are very nearly equally derided—
but I still think it willbe carried.

“The CommitUee, An. beg leave to report,
that (hey here labored in vain lo digest e
plan upon which such a Court can bn eats
bliahed without imposing no additieoaltaa no
the public, and increasing the expeose of
suitors. WHW regard iu the additional pub
lie expense, which would result from aucheu
iastittilkm, it it aleer to the minds of your
committee, that such an establishment would
necessarily add several to the present list of
officers in this elate, and Aet thcln offices
should be filled by person* poreesiiqng the
best talents the stole affords, end that those
officer* should hare a salary, suitable to their
taleote end service*. And with regard to
increasing the expense on soitors, it is belief
ed by your ooiUmitte the Constiiution of this
coentry guarantees to every citizen the privi
leg* of appearing before.any tribunal known
to the lews of (lie land, by attorney, and your
committee are entirely at a low lo understand
how attoroies of such rank end Interne as
would be proper to plead and practice in such
a court, oould be employed without compen
action for their services, which compensation
would uecaaaarily come from the pocket* of
theirsuitora. Your Committee ateefopioion
that the establishment of such an institution
would increase A* very evils which it is in
tended to remedy, lor your Committal can
not indulge the belief, tint the warmest ed'
vocatedbr a Court of Errors and Appeals
would atseol to a departure from the well
known principles of this Government, so far
as to hare the officer* of Ail Court (if inch an
one should be esteblished)filled by any persons
for life. Then your committee hare reason to
apprehend the existenceofsome of the evil* al
least io thit coart, which are complained of un
dev our present Judiciary system, for if those
officers are elected periodically, their succes
sors may with the same propriety disregard
'the rules and decisions of their predeoeasort,
end establish a new system for their govern
ment. as do th« 'Judge* of our Superior
Court*. Your eommittee find that the peo
ple ard very much harrataed and perplexed

ready established either in Ae character of
suitors, juror* or witnesses, and that Ae op
port unities to defeat the end of justice by on
necessary appeals and delay, are already too
numerous, qven under our present judiciary
system—all of which evila, in tbs opinion of
your committee, would be multiplied, should
a court of errors aod apneals be established.'’
Such are lb* reasons against the establish
ment of a court of Goal resort—it i* unneces
sary to add that no such court will he estab
lished during the presear session.
. On tlie tame day, another attempt was
made to bring up lbs bill to abolish' Peniten
tiary punishment by moving to recoasider
the vote, which went on the preceding day
to reject Ae bill—bat the reconsideration
was rejected by a vote of 57 to40. I cannot
but express my sincere gratification of this
result.
