RELATIVE TO A CITY COURT.
The Code of Georgia provides
that, upon the recommendation of
the grand jury of any county
having a population of ten thou
sand or more where a city court
does not now exist a city court
shall he established for the coun
ty. The grand jury at its next
session will be asked to pass up^
on the matter of a city court for-
this county. Those who have
looked into the subject appear
all to favor this establishment.
For several years the business
in the superior court has been
increasing. The two weeks term
has not sufficed to dispose of all
the business before that court.
Last year Judge Edwards called
an extra session of the court to
dispose of the unfinished busi
ness. Generally for Home reason
it is impossible to acconmlish
with adjourned terms what
should be done. At a regular
term of court everybody has for
some time been anticipating the
convening and have prepared the
cases for trial.
There are some cases over
which a city court would not
have jurisdiction, and these are
felony cases—or the higher grade
of criminal cases; cases involv
ing title to land, divorce cases
and equity cases, such as injunc
tions and the like. It is provi
ded that city courts shall have
jurisdiction over all cases ex
cept those where the superior
court has exclusive jurisdiction
This would not mean that all the
civil cases must of necessity be
brought in the city court,> but
that they could be brought either
m the superior court or the city
court.
The law provides that city
courts shall have quarterly terms
beginning on the first Mondays
in March, June, September and
December. The judge is Rjso
give% power to hold this court
in session for a period not longer
than four weeks from the begin
ning of each term, thus giving
time to fully dispose of all busi
ness.
Misdemeanors can be tried on
accusation and without first hav
ing an indictment of a grand jury
but the accused person can de
mand an indictment and give
bond till the grand jury meets.
The solicitor general of the ju
dicial circuit is ex-ofli£ia«plioitor
of the city court, but the judge
of the court can appoint some
one to act as solicitor pro tern iu
the absence of the solicitor gen-
esal.
The sheriff and clerk of the
court are paid fees the same as
the sheriff and clerk of superior
court.
Only 24 jurors are required in
the city court.
Civil cases are made return
able to the first term and stand
for trial at the second term after
filing—the same rule that ob
tains in the superior court. But
as only three months intervene
between the terms of court busi
ness can be disposed of much
more rapidly than iu superior
courts.
Whenever there is much busi
ness in a county and a city court
is once established it has been
found that its benefits are such
that the people have no disposi
tion to abolish the court.
The chief critcism of courts of
justice has been the delay in de
ciding eases. Clearly the way
to prevent delay is to have a
court whose term are irequent
enough to dispose of the business
without waiting half a year.
There are now numbers of cases
on the docket of the superior
court which it appears will re
main undisposed of for several
terms to come.
Since other counties have tried
city courts and found them to
greatly aid in the Administration
of justice and to be a real bene
fit to the county, why should not
Paulding county try the same

A Literal Postmaster.
When Amos Kendall was post
master general at Washington, so
the story goes, he wrote one day
to the postmaster at. a little sta
tion on the Toinbigbee river:
“,You will please inform this de
partment how far ^he Tombigbee
river runs up,” to which the
postmaster answered: “I have
the honor to inform the depart
ment that the Tombigbee river
don’t, runupatall; it runsdown.”
In due course of mail came an
other communication: “On re
ceipt of this letter your aopoint-
ment as postmaster will cease.
Mr. -has been appointed
your successor.” To which went
the following reply: “The re
ceipts of this olfiee during the
last year have been $4 37 and the
ollice rent more than double that
sum; please to kindly instruct
my successor to pav me the bal
