Mr. Lloyd, for the defence, said that the evidence
plainly showed that not a moiety of the original house
was repaired, but admitted that Lis client had tlffough
ignoranca of the law, sot about the repairs -without
having first got the sanction of council. He contend
ed, however, that nut more than a moiety of the house
was repaired, and therefore it did not come under that
section of the ordinance.
Mr. Hartridge, for the prosecution, said, that the ad
missions of the counsel for the defendant were fatal.
He Usd violated the law by even repairing his house
without having first obtained permission of Council.
After reading the different sections ot the fire ordl-
uance and explaining their intention, he said it was
the duty of the Mayor and Chief Fireman to apply
the law to this case.
His Honor remarked that under the seventh section
of the ordinance the violation was obvious, and under
tha tenth section, the case must either be settled by-
fine, by pulling down the house, or by compromise,
and said he would therefore refer the case, under that
section, to the Chief Fireman for the enforcement of
the ordinance, if after examination it be found that
the ordinance has been violated.
