Not Responsible fop. Acts Cojiuitted.—
I ml .i,’ Campbell one (lay last week, in Nnsli-
ville! rendered n decision involving points in
which nil who fought for the "so-called’’ are
directly interested.
We copy from oue of the Nashville dailies.
It appears that in September. 1861, Captain
,j }[ Hawkins, who at that time was acting
as military conductor on the Louisville and
Nashville' Railroad, took from a Mr. Craig
who was on iii.s way North, the sum of $100
m cold, in accordance with standing orders
from General Foster, that all valuable arti
. lc-s should be taken from persons passing
through the lines to the enemy.
Shortly before the close of the war. Mr.
Craig filed a bill in’the Chancery Court
against Captain Hawkins, then absent in the
South, for the recovery of the sum iu ques
tion. When Capt. Hawkins returned, he de
murred to the bill, on the ground that he was
acting under orders from Generals Foster
and Auderson- On this account the bill was
withdrawn and amended so as to include the
latter in tho responsibility desired by llie act.
A second demurer was then entered, based
on the plea that the money was seized as a
matter of military precaution, and that the
act was in accordance with the recognized
rules of civil warfare.
Tlie decision made by Judge Campbell
yesterday sustains the demurrer, on the
ground that the Confederate Slates were re
garded as belligerent, and that the defend
ants were justified iu enforcing such meas
ures as were justified by the laws of war.
