as .1. Rusk, that John Lind; in Ins lifetime execu
ted a bond to one John Bull to make titles to Lot of
Land No. one hundred and nineteen, in the ninth Dis
trict of Carroll county; and it appearing to the Court
further, that the said Thomas J. ttnsk is the bona tide
holder of said bond, and it farther appearing Ilia! John
Black departed this life without making lilies to (lie
same. It is ordered by ti e Court, that the adminis
trators of the said John Black, deceased, do exoculo
titles to the said lot of land, to thesaid Thomas J. Rusk,
unless good cause be shewn to the contrary within the
lime prescribed by law ; it is farther ordered, that

To the lion, the Superior Court of said county*.
T HE petition *>f Charles llulsey respectfully shows,
that heretofore, to wit: on the eighteenth day of
March, eighteen hundred and thirty, tin? said Frede
rick A. Brown andJabez Lewis, made, executed and
delivered to your petitioner,their certain deed of mort
gage, bearing dale the day and yem aforesaid, and
which is here iu Court ready to be shown, which deed
"f mortgage conveyed a certain tract or parcel of land,
situate, lying nnd being in said county of Hall, known
as Lot No. ninety-six, in the ninth District of said coun
ty, which tract or Lot of land was mortgaged by the
suid Frederick A. & Jahez, for the better sccuringto your
petitioner the payment of a certain promissory note
made and delivered to your petitioner, by the said Fre
derick A. & Jahez, on the day and year aforesaid, for the
smnofthree hundred dollars, and duo on the twenty
fifth day of December, eighteen hundred and thirty,
gather with a certain other note described in taid
ortgage, and which is not yet due, and which said
first mentioned no»o is herewith shown to the Court:
and your petitioner further shows that the whole
amount of principal and interest on said note, is now
due and unpaid. Wherefore be prays, that unless the
said Frederick A and Jabez, pay into the Clerk’s Of
tier of this Court, the amount ofthe principal, interest
and cost due thereon, within six months from this date,
that the equity ofredrmolion in, ond to the said mort
gaged premises, thenceforth and forever be foreclosed.
Therefore on motion of Council for the plaintiff it is or
dered by the Court, that the said Frederick A. Brown
ami Jahez Lewis, pay into the Clerk’s office of this
Court the amount ofthe principal and mtercst due on
said note, together with all legal costs, on or before
the expiration of six months, otherwise the equity of
redemption in and to the said mortgaged premises, bo
forever barred and foreclosed; and that a copy of this
rule and petition he published once a month for six
months in one of tho public Gazettes of this state, or
that the defendants be personally served therewith,
three months before the next sitting of this Court.

his bond or obligation to him,the said Bradley,to make
him the said Bradley, good and sufficient titles to lot
of I*and No. 85, in the 10th District of Hall cotinfv,
and that the said James Bradley lias lost or mislaid
said Bond, so that he cannot como at the same.
