Ttie Bond Case.—In staling the parlies to tins cause yns'erdny, we woro in error in na ming the Defendants, Wo should have stated the Defendants to have henn Messrs. Isaac C. Holmes, Alexander Mazyck, and Thomas Gadsdcn Pile cause was fully argued yes terday, not regnlurly on its .merits, but on a preliminary motion for the right to implead be fore a Jury, us to the law us well as tho facts of the cose. Robert B. Gilchrist, Esq. District Attorney, opened with a clear and succinct statement of tho case. He contended, llmt, under (lie act of Congress ofl799, tho Defend ants were not entitled to nny defence, unless they made affidavit that there was an error in the calculation of the duties, and that, in defaull ol this, the Court were bound to give judgment tor the Plaintiff, simply on a motion made to this effect. J. G. Holmes, Esq. followed, and denied the construction given to tho Ac* of 1799. Ho insisted, that tho interpretation given to that Act liv the District Attorney, would deprive the Defendants of the right of trial by Jury, guaranteed hy the Constitution of the United States ; and concluded, by of fering a motion, that the Defendants have “permission to plead.” Messrs. McDuffie and Petigru then followed ; and wont at large into the question of the right of tho Jury to determine on the Law as well as on the Facts of the ease, in any civil suit submitted to them. Mr. McDuffie relied mainly on that amend ment of the Constitution of the United States, securing to the citizen, in all suits at common law. the right of trial by Jury, when the sum is ©20. and upwards. Mr. Petigrit relied on precedent and practice, as going to restrict that right to criminal cases. Tho City Gazette of the 21st ult. says:— ‘ Tho case was decided without going to the Jury. The general issue has been put in ; it was found the constitutionality of tho luw could not be made a question, and thoro was no evidence for tho panel. Some excitement has been produced from rumors of n rovolt among the negroes in North Caroline. The report has beon very much exaggerated, although there was some foundation Tor it the existence of the plot u clearly established, but most fortunately a disclosure ■ru» made which frustrated iheir plans. The excite ment in many part* of the State of North Carolina was very great, and appears to bo increasing. It is mentioned in the Philadelphia Chronicle, that it TJ proposed to raiae in that city a company of volunteers to go out in aid of the Poles. The Builingtoo Press of the 1 Sth ult. contains full return, of the* elections in Vermont. No Governor has been elected. The votes stand for Allen 10050, Fanner 0056 Meech 3828. The votes for Councillors give an average of 9#05 for the Netionel Republican Ticket, 0384 far the Anti-masonic, and 3828 for the Jaekion.
