recover damages for tho breach of a parol con
tract to deliver and pay for a certain number of
railroad stringers, it became material to show
that a portion of the atringera had been deliv
ered and paid for under the contract;
I ft hi. That a witness who only know of the
existence of the contract from hearsay, might
testify that. In making Ibo delivery, tho parties
acted on tho oontiart, since this is no more than
saying that they acted on what they claimed, or
supposed to be, the contract. The testimony
does not go to show there was a contract, but
to eiplslo tho delivery, and is admissible as
part of the ret i/ethr.

on a trial for Ibe breach of a contract to re
ceive and pay for a Used number of railroad
stringers at #15 per thousand feet, and there
was evidence of the number of thousand feet
