Killed.
One of the moat frightful accidents that ever
occurred in this connly, occurred yeaterday
learning, at Bailey's Mill, fear miles from the
city. At thfe point there is a long, narrow
bridge over Rocky Creek, the bridge being
about twenty feet high and the bad of the
stream very rocky.
Yesterday morninp, about 10 o'clock, Messrs.
Duke W. Braawel! and Alexindcr 8werney were
driving acrcss the bridge in a baggy drawn by
a male, when the animal took fright at a loose
plank and began to back. Before the men were
hardly aware of the eilnation, or oonld do any
thing to aaTe themselves, they and the male
and taggy were tumbled over the edge of the
bridge iDto (be abyss below. The railing was
pone from the bridge end (here was nothing to
prevent the fearfol disaster, and in a minute’s
time the men wero lying ineenaible npon the
racks beneath, the male was lying near them
deed and the boggy was broken into fragments.
It sssms almoit a miracle that the men es-
eiped instant death—falling ao great a distance
npon a perfect bed of rocks. Especially la Ihie
the case with Mr. Braswell, who Ii about sixty
years of age end srelgbs shout two hundred
p uanda.
People In the neighborhood went to the a*,
eiatance of the nnfortnnsle men ss soon es pos
sible, and s men via posted off to the city for
a doctor. Dr. O. E. Sustdorff went ont as
qntekly aa possible and did what he ooald for
the iajaned men. Dr Crowell W. Johnson was
elan early upon the aocna.
Hlrcnlar aa it may eetm. though hath men
were fearfully Injured, neither of them had a
aiagie hone broken Ur Braswell bad ono of
his cy*e eompletaly knocked out, and had aev-
era! severe cats and eontnslona about <hs bead
railroads, u to the Uimlof a junction within
the city (of which the Macon and Wtiterc road
was ooo of the parties), the road la estopped
from obtaining .obeeqnent, or Belting op this
exemption. We do not think ao, but regard the
agreement ae stipulating that the question of
taxation was properly left ont of the agreement;
In other words, that it (the agreement) should
not be an estoppel, and that the matter of taxa
tion should be exercised end deierminid accord-
log to lew, aa any other m it ter that might arlre
entirely outeido of the agreement.
We srtll not argue the question of poliey as
to the municipal taxation of the appurtenances,
farther than to eay that, io the event the State
aboold give the pewer to tex the road-bed aad
appnrtenacces, aa so much real or personal
estate, situate in the county of Monroe (the case
put for illustration) we do not think it necessa
rily fallows that the county would make by ex
ercising the privileges.
Whereupon, after argument had is the case,
on such days aa have been agreed on by the
parties, and in fall consideration of the prem
ises, it is ordered that the writ of injunction do
ia-ne, as prayed for in the complainant’s bill,
and that such other proceedings be had there
in, as is nsnal in eqnity, and that this order and
judgment be entered on the minutes of IheBibb
Superior Court by the clerk thereof.
