Ordinance No. 346
An ordinance to provide for the
paving of Central Avenue, from
the alley lying parallel between
Thomas and Sheridan streets west,
to and across Johnston street,
with the exception of that portion
of Central Avenue embrased with
in the park in said avenue, to-wit:
Thirty-one feet; Johnson street,
from Central Avenue, North to the
tracks of the Atlanta, Birmingham
and Atlantic Railroad Company;
Pine Street from the point where
the paving of said street termi
nates at Sherman street, Kast to
and across Sheridan svreets; Main
street, from the point where Pine
Street intersects it on the South,
North to Central Avenue, with tne
dxception of that portion of Main
Street embraced within the park
in said street, to-wit: Thirty-one
feet; that portion of Sherman
street lying between Central Ave
nue and Pine street and that por
tion of Sheridan Street lying be
tween Central Avenue and Pine
street, all in the city of Fitzgerald;
to asthorize the Mayor and Street
and Alley Committee of said city
to contract for said work to be
done and to provide for the assess
ment ot property adjacent to these
streets of two-thirds, (§) of the
cost thereof and for other purpos-
Sec. 1. Be it ordained by the
Mayor and Council of the City of
Mtzgerald, thav that portion of
Central Avenue, from the alley
lying parallel between Thomas
and Sheridan Streets, West, to
and across Johnson street, with
the exception of that portion of
Central Avenue embraced within
the park in said avenue, to-wit:
Thirty-one (31) feet; Johnston
Street from Central Avenue, north

termined by the Mayer and Street
and Alley Committee of said City..
Sec. 2. Be it further ordained,
by the authorities aforesaid that
the said Mayor and the said Com- |
mittee shall make a contract forl
said paving which 1s most advant
ageous to the city, said pavizg tui
cost the sum of Two Dollars and
twenty cents, ($2.20) per square
yard,
Sec. 3. Be it further ordained
by the authority aforesaid that Lhel
cost of said paving shall ve borne
as follows: There shall be paid out
of any fund available in the city
treasury at such time as may seem
best to the city, in accordance
with the contract made for said
paving, one-third (%) of the total
cost of said paving and there shall
be paia by the owners of property
adjoining the said streets, two
thirds (§) of the cost of such pav
ing, said two-thirds, (%) of such
total cost to be proporbioned‘
equally between property owners
on each side of the streets paved,
which is to say, that the person
owning property with a frontage
of one hundred (100) feet on the
side of one of such streets, shall
pay two thirds (}) of the total cost
of paving sid street from the
middle of the same up to his pro
perty and for a lateral distance of
one hunared (100) feet up and
‘down said street, so that the total
cost of paving said streets shall be
borne, one-third (}) by the city of
Fitzgerald and two-thirds (%) by
the adjacent property owners, to
be equally divided between them
in proportion to the number of
front feet of real estate owned by
them except insofar as relates to
those portions of saidstreets which
cross the alleys of the city ana the
total cost of paving the portions
of said streets which cross alieys
shall be borne by the city of Fitz
gerald, the cost in no event and to
no property owner, nor to the
city to exceed the sum of Two
Dollars and twenty cents, ($2.20)
per sq. yd.
Sec. 4. Be it further ordained
that the Mayor and Street and
Alley Committee of said city coun
cil shall cause said work of paving
to begin and be preceeded with at
as an early a date as is practicable
and the said work of paving shall
be done under their supervision
and in & manner satisfactory and
acceptable to them.
Sec. 5. Be it further ordained
that as soon as this ordinance is
fully passed, it shall be published
once a week tor two weeks in the
official organ of said eity and that
no other notice than the publica
tion of this ordinance shall be
necessary in order to make the
same effective for the purpose of
which it is intended.
Sec. 6. Be it further ordained
by the authority aforesaid that the

Mayor and Street and Alley Com
mittee, be and they are hereby
authorized to maake a contract un
der the provisions of this ordi
nance for the curbing of the above
named streets, at and for the price
of Korty-five cents per lineal ft.
They are authorized, in addition,
to make a contract for the con
struction of catch basins, storm
sewers, a drainage system to be
used in connection with the above
described paving at a cost not to
exceed Thirty-seven (37) cents per
lineal ft., the said cost of both
curbing and drainage system to be
proportioned in the same manner
that the cost of the aforesaid pav
ing is proportioned under this
ordinance, to-wit: One third (%) of
said cost shall be borne by the
City of Fitzgerald, to be paid out
of any funds available for that
purpose in the city treasury, al
such time as the Mayor and saic
Committee may find expedient anc
best. The other two-thirds, (%) of
said cost to be paid by the proper
ty owners owing property adjoin
ing the aforesaid streets in the
proportion that the frontage of
any property owner’s property
bears to the whole area paved;
payment to be made by the pro
perty upon suck terms as may be
arranged by contract between the
Mayor and Street and Alley Com
mittee and the contractor doing
the work,
Sec. 7. Be it further ordained
that all the provisions of Sec. 68
of an Act of the General Assemb
ly of Georgia, entitled ‘‘An- Act
to amend an Act incorporating
the city of Fitzgerald, in the coun
ty of Ben Hill, Approved Aug.
22nd, 1997, and for other purpos
es,” be adopted as part of the pro
visions of this ordinance and that
said work be done in accordance
with the provisions of said Section
of said Act,
Sec. 8. Be it further ordained
that all ordinances and parts of
ordinances in conflict with this
ordinance be and the same are
hereby repealed.
