South cf the Oconee and Alatamaha Rivers, that is to fay beoin
ring ar the upper extremity of ti.e hign finals of rhe Appaiachee
Fiver, the fame being a branch of the Oconee River, and on

to a nmtd ford of the fouth branch of Little River, called by the
I dians, Chato-chuc-co-ha chee ; thence adireff line to the mam
branch of Commihloners Creek, where the fame is interfered by
the path leading from the Rock Landing ro the Oakmulgee Old

Oakrmdgec Liver; thencedown the middle waters of the laid Creek,
to Oconee River, and with the weftern bank of the fame to its
juadhon of tne O.ikmulgee River ; thence acrofs the Oakmulgee
River to the fouth bank of the Alatamaha River, and down the
lame, at low water mark, to the lower bank of Goofe Creek;
and from thence by a dueff line to the mounts on the margin of
the Okefinneau Swamp, railed and eftablifbed by the Commil
fioners of the United States and Spain, at the head of St. Mary’s
River ; thence down the middle waters of the laid river, to the
point where the old kne cf demarkation ftrikes the lame j thence
with the faul old line to the Alatamaha River and up the lame to
Goofe Creek, to which the Indian title has been extinguilhed by
treaty concluded near Fort Wilkinfon, on the 16th day of June,
iSo2; ihall, in conformity to the twenty third feeffion of the fir ft
Article of the Conftitution of this State, be laid off into three
counties in the following manner : that is to fay, that part of the
fail territory lying fouth of the Alatamaha, to form and conffitutc
one county to be called Wayne ; and that part of the laid territory
lying fouth of the Oconee River, to be divided by a line to be
run according to the true meridian from the Oconee at Fort
Wilkinfon, fouth, forty-live degrees weft, to the Indian boundary
line, into two counties, the eaftern to be called Wilkinfon, and
the weftern to be called Baldwin, and ihall be divided by the
Surveyor General or fuch of the diftrict Surveyors as he may think
proper to appoint, each county into diftn<sts ; the county of
Wayne into three diftrifts, which diftrieffs full be as nearly equal
as the circumftances will admit, to be laid off in fuch manner as the
Surveyor General may deem moil expedient, and the counties of
Wilkinfon and Baldwin, into live diftriffs each, as nearly equal in
extent as circumftauCes will permit, by lines which fhall run
parallel with the dividing line between thofs counties.
Sec. 2. Anile it farther enabled by the authority aforejaid , That
the land contained in the feveral diftriffs, Ihall be divided by lines
running parallel with the dividing lines of diftrifts, and by others
eroding them at right angles, lo as to form tuffs of forty-five
chains fquare, containing two hundred and two and a half acres
each, plainly and diftinffty marked, in a manner different from
the' ordinary mode heretofore purlued for marking lines in
this (late, to be pointed out b/ the Surveyor general; except the
county of vVayne, which fhall be laid off into traffs of feventy
chains fquare, and to contain four hundred and ninety acres each,
unit ft where the line which is to form a temporary boundary
between the faid territory and Creek Indians or the courfe of navi
gable rivers may render it impracticable, and then tins tine flnall he
departed from no further than iuch particular circumftances may
require ; and all fractional parts of furveys which may be created
by the courfes of navig ;ble rivers; bv the temporary boundary line,
or other unavoidable circumftances ; and all iffinds witninthe
limits of the la'd territory, and lying fouth weft of Tie middle or
main fource of the Oconee or Alatamaha Rivers, fhau be referved
and (Lid, and the fun is arifing therefrom, be appropriated in luch
manner as a future Lagiflature may direct: rclerving, neverthe
iefs, to the fortunate drawers, rcnpeclivelv, of tne tracts or
fed ions of land adjacent to fuch fraffional parts of furveys or
iftands, a preference for twelve months from ai d auer rae com

oec. 4. And Is if further enabled iy the authori'y aforefaid^

ten rhoulapd dollars, with fuch lefurity as the Governor, ora
majority of the Jufliccs of the Inferior Courts of the rtfpeftive
Counties, where the laid furveyors tray ft fide, which bond (hall
be taken by the Governor or the afurtfaid Jullices, anddepofi cd
in the Executive Office, ffiall approve of, for the faithful dif
ci tree of die trull tepolcd in, and duties required of them by
this Act. 7
Slg. 5. And he it further enabled ly the authority aforefaid\

ot iliis Ad, to make the furveys of the diltrifts to which they
may rtlpeftively be appointed in their own proper perfon j to
mark or caufc to be marked plainly and diftinftly upon trees,

may he required of them to run for the purpofe of making
the furveys in their rtfpeftive dillrids immediately after the
boundary line ihall have been run by the proper authority,
to caule all fuch lines to be meafured with the utmofi pofn
blc exadnefs, with a half chain containing two perches of fixrc cu
Uec and one half each, confiding of fifty equal links i which ffiall
be adjtided by a fiandard to be kept for that purpofe in the Sur
veyor General’* Office i to take as accurately as poffible the mean
ders of all water courfcs which Iball form nnuial boundaries to
any of the furveys, and of all navigable rivers whereby any of
Inch furveys may happen to be divided j to note in field-books
to be kept by them rdpeftively, the names of the corner and
other flation trees, which iball be marked and numbered in fuch
manner as the Surveyor General Hull dbeft ■> alfo all rivers, creeks,
and other water courfcs, which may be touched upon or eroded
in running and me during any of me lines aforefaid ; tranferipts
of which field-books after, being examined with the originals,
by the Surveyor General, and certified and figned on every page
by the Diftfift Surveyors returning the fame, ffiall be depofued
in the Surveyor General’s Office, there to be prefi rved as a re
cord, to make a return to die Surveyor General within ninety days
after the running the boundary line as aforefaid of a map of the
diftrift to which they may rdpedively be appointed, in which
Iball be coirtftly delineated, reprefented and numbered, in fi cli
order as the Surveyor General (ball preferibe all the furveys within
fuch diHi id i and alio to return at the fame time a detached plat
of every fuch furvey of land, certified and figned by them, which
plats iball be filed among the other records in the Surveyor Ge
neral’s Ofike, and from which copies fnail be made to be annexed
to grants ; and to conform to fuch inftruftions a , they may receive
from the Surveyor General from time to tune during their conti
nuance in office, and progrds in the duties thereof, not militating
with this Act.
Stc. 6. And he it further enabled by the authority aforefaid\
That the furveyors fball receive as a compenfation two doll irs and
feventy-five cents per mile, for every mile that ffiall be actually
run or furveyed to compenlatc for returning maps, plats and field
books, out of whicli lum they ffiall defray the expenccs of chain
men, axe-men, and every other expcncc incident to the laid bu
finds, for three hundred dollars whereof, the Governor is re
queued to ifiue his wan ant on the Treafurer, in favor of each and
every Surveyor, immediately after their entering into bond and
fecurity as aforefaid, to enable them to proceed without delay, to
the execution of their duties , tor the balance of which by this
law they may be entitled, they fhall receive a warrant in like man
ner, on producing to his Excellency the Governor, a certificate
from the Surveyor General letting forth that fuch Surveyor has
completed the dunes affigned him, and made hb returns con
formably to this Aft.
Sec. 7. And he it further enabled by the authority aforefaid ,
That the Surveyor General or DillnCt Surveyor, or Surveyor,
who may be employed in dividing the faid territory into Counties
and D.drifts, ffiall receive the fame compenfation for each mile
run and furveyed, as is allowed by this law for other Surveyors*
out of which all expenccs incident thereto, mud be paid without
any additional charge on the ftatc, and his Excellency the Go
vernor is requefted to grant his warrant on the Treafurer, for
compenfatmg that fcrvice, lb foon as he Iball be advifed by the
Surveyor General of its completion.
Sec. 8. And he it further enabled by the authority aforefaid ,
That the faid land ffiall be appropriated by lot in the manner fol
lowing, to wit : after the furvc)ing is completed and the returns
made to the Surveyor Genera), his Excellency the Governor,
fhall caufc tickets to be made out whereby all the numbers of the
furveys in tie different dilfrifts, ffiall be reprefented, which tic
kets ffiall be put into a box to conftiture prizes, "ith others to be
denominated blanks, of which blanks the number or amount ffiall
be determined, by fubtrafting the number of prizes from ihe
whole number of draws, to which the fa : d lottery fball be lubjeft
upon the following principles : that is to fay—Every free male
white peifon twenty ore years of age and upwards, beingacitizen
of the United Sratef, and an inhabitant of thisfiatr, twelvemonths
immediately preceding the pafiage of this Aft, or paid a tax
towards the fupport of government (including fuch as may be
