A case of considernhln Importance was
tried last week during ihe silling nf Ihe Su
preme court New Bedford. Massachusetts.
It was an action brought by Giecn and
Gilihe, merchants, t'- recover from the mer
’chants’ liisurhnce Ciinipariy the amount of
a policy of iusiiraiice effected upon ihe
sloop Falcon, during her Voyage front Sa-
vnhnali lo New York and Netv Bedford,
in Ilia summer or 1827, the sloop having
been cast away upon the shoals of Cape
Looltofil, during that voyage.
The defendants assumed two points of
drfehce: the first, that the intemperance
of Ihe captain disqualified him for the du-

The cliargo against the captain was nnt
prosed to tlm satisfaction nf the jury. Tlie
court decided that the point was good in
law, could it he sustained, ns-tha law pro

admitted by the plaintiff, was read. It
was written nn the 24th July, in New
York, by Mr. Gibbs lo iiis joint owner. Mr.

uhence she vailed on the IStii, and bi<
brought intelligence that the Fafriun sailed
