press, and circulated all over the eountry; but the
majority ol those who are killed while walking or
lying on the track are never hoard of, beyond their

proved machinery and skill, too, are beginning to
diminish tins amaslt-upa, formerly so common on
our roads, thcro would seem to be an Incroatc ol
accidents from this eause, in proportion to tho in*
erraHed number of miles of railroad going into
operation. The evil, besidos, has boon rather aug*
men ted than diminished by tho building of double
tracks. When these had no oxisienco, tho indi
vidual who trespassed on tho single track by got*
ting off tt, on the approaoh of a train, might be
considered ns perfectly out of dangor; but such is
not the caso whore a duublo line has boon laid
down. As long as a certain proportion ol ntan*
kind remain "dull of hearing," are easily fright
ened, or naturally stupid, tho inouting of two train!
will always afford incrensod opportunities for rail
road slaughters ; as such pnrtios aro sure to step
Irom one track to the other, hardly anticipating ilia
possibility ol such an occurrence.
Now this wholo tiling is a grovious wrong, and
ought to bo, aa it can bo, instantly pul a stop to.—
In Europo not one accident occurs from this cause
lor twenty in this country ; though tho population
1 in tho former is muoh more donso than in tho lat-
I ter, and tho liability to injury or lot* of lile, thoro-
i by corroepondingly incrensod.
What wo want in this country ia more stringent
legislation on tho subject. Every set of unneces
sary trespass on tho track of a railroad, should b*
innde punishable by law. This would deter al*
parties Irom unnecessarily venturing on it,near the
stations, whero most mischief ot this sort happens;
while it would drive from other pnrts of the rend,
tho timid and tho thoughtless, who aro by far tho
majority of our present victims. The law would
nleo take sides, as it ought to do, with tho com
panies in all such casts. At present, individuals
trespass at their own risk ; but thi* is not enough,
as sad experience has shown The bold and rock*
less venture with no qualms of couscieneo that
they aro breaking the law. “Ono is taken and tiro
other left," tho former, probably, having ventured
into the danger by tbo oxumpto of the latter, who
escaped, because he po:-aod*ed qualities ol body or
tniud which the other lacked.
Legislation has been entirely too much onesided.
It has tied down corporations by every possiblo
means, and protoctcd tho public against them.—
Judicial decisions, too, wu hclievo,havo been more
or less tinged with the feeling,that where mischief
t"i>k place, tho companies must have been in the
wrung. We think tho tirno has come to givo both
sides a fair chunco. The public, so far, have eor-
tamlv been g eater gainers from the oonsiruciion
ol rai ronds than the companies themselves. Then
why lor ever legislate, ns if the latter wore a com
mon nuisance, always in tho wrong, and alwny 8
disposed to maliciously inflict lots and damage on
thenuolic? Why not protect them as well ns
