Mr. Bilbo, summoned by the piff,
was among the absentees when the
witness roll was called, and a court
order waa issued directing the United
States marshall to locate him with a
peremptory summons. So far as can
be ascertained here the eourt order
hat not yet been served. Word from
poplarville, his home, was that Mr.
Bilbo left for an automobile trip be-
fore the arrival of the deputy marshal
with the mandatory order for his ap
pearance.
For this reason trial of the suit was
suspended Saturday afternoon until
Monday to allow more time to locate

Mr. Bilbo nnd MaJ. Perry,
bar of tha Governor’s staff, are
alleged by the plaintiff to have an
intimate knowledge of the eircum-
stances which followed the incidents
alleged In tha petition for redress and
of negotiations which she asserted
friends of tha Governor undertook.
The trial, which began last Mon
day, hat developed much directly con
tradictory testimony. Gov. RuiseU
denied tha allegation categorically
while Misa Birkhead reiterated them
in detail when the two appeared
the witness stand. Evidence of
for the plaintiff gave Miss Birkhead
reputation prior to the incidents
she alleges, of the best, while the
testimony of witnesses for the de
fense cited various alleged incidents

and playing "ragtime” music on a

Miss Birkhead charged the Governor
