torney filed a motion that the Court
dismiss the suit tor want of jurisdic
tion, and this motion was argued «»n
Saturday last. Chief Justice Carter
overruled the motion to dismiss, and
liehl that no Court could deny tiro
plaintiffs the right to prove a title
against any persons holding land
claimed by them. This case is iden
tical with the ,Ar£ngton case.. In the
latter case the Attorney-General of
the United Stales lias tiled a sugges
tion informing the Court that the
United States :s in possession of the
property through its officers and
agents, the only possession that it is
capable of having and in using it in
tin? execut on ot its s^verigu and con
stitutional powers, lie ba$ sugg fr
ied to the Court that it has not juris
diction to take any action which will
tend to disturb the possession of the
United States, and has filed a motion
to dismiss the suit. This motion re
mains undecided, but it Judgc
Ilughes follows the precedent of
Judge Carter’s decision, he must
overrule the motion and jiermit Gen
eral Lee to proceed.
The discretion and history of this
estate are graphically given: It cov
ers over a thousand acres, and the
Arlington House from 1802 was the
residence, until his death, of George
Washington Parke Custis, the adop
ted son of George Washington, when
his daughter, the wife of General
Robert E. Lee, occupied it till 1861.
Gi-neral Lee then left it, with his
family, to go South and join ti.cCon-
^ federacy. It was soon after taken as
the millitary headquarters of General
McDowell, of the United States
Army, and was held by the millitary
till 1863, when it was sold by the
Government, under the Direct Tax
act for 865 of overdue taxes. The
money was tendered by General
Lee’s friends, bat refused. It be
longed to Mrs. Lee, and was not con
fiscated, as is generally suppo-ed.
General Lee never had any interest
in it whatever, and that of Mrs. Lee
was only a life estate, so at her
her death it reverted to General
Custis Lee, who brings the suit at
ejecl-neiit. In 1867 a national ceme
tery was formally established by the
Government upon two hundred acres
of land, in which there are hurried
nearly sixteen thousand soldiers, in
cluding a few hundred of the Con
federate army. Over the arch of the
carriage entrance is this inscription:
*‘ Here rest 15,585 of the 315,558
citizens who died in defense of their
country from 1861 to 1865.”
