THE MA YOB AND THE COUNCIL.
The Mayor seerua to have incurred the dis
pleasure of a portion of the Council, because
he has refused to be governed by their instruc
tions as to voting the City Stock at a late elec
tion of a Board of Directors for the Macon
Gas Company—he having voted according to
his own discretion and without fear of the
Council before his eyes. Whereupon we have
a Protest in yesterday’s Journal <f Meuenger,
signed by Messrs. Anderson, Jones, Freeman
and Harrison—wherein the Mayor is arraign
ed for usurpation of powers, and the reason
given for its publication is that they appre
hended a majority of Council would object to
its being spread on the Minutes.
These gentlemen take the position that the
Mayor has no right or power to represent the
City Gas Stock; but if we are correctly in
formed, at tiro time the resolution was adopted
authorizing the Mayor to suliscribe for it, an
additional resolution was passed investing him
with the management of said stock. Refer-'
ence to the recordset' Council will show wheth ■
er this be correct or not. But what authority ,
has Council to dictate tojthe Mayor how he shall ’
vote? There is no precedent for it, and it is
certainly contrary to principle. The Mayor is ,
not the Agent of the Council but of the Citi- |
zens. and it savors strongly of presumption
for Council to attempt to mstrnct him. It |
would be a pantile! case if the Legislature
were to instruct the Governor to resign.—
Principle and,precedent both being against
these instructions, was the Mayor right or
wrong in disregarding them ?
A majority of Council neverdid pass the resolu
tion of instructions. It was passed by a vote of
only three members—two voting against it, and
three refusing to vote all; and at the next reg
ular meeting, the resolution was erpeinged i
from the Minutes. Thus the Mayor has been
sustained by Council; and if the gentlemen
who issued this protest feel aggrieved, the
proper way to ap|K*al to the people is not
through the newspapers blit at the ballot luix.
They say that their rights have been violated—
that a fraud has been committed; then why ,
do they remain in a body where they are pow
erlee- ami w here they are in a degree re
sponsible for its acts I Uy all means let them
resign; they can run again and the people wil 1
hare a chance to decide between the two par
ties. A fair showing is warranted them.
As a public journalist we have seen fit to I
say this much on a subject in which the cem
nmnity'is interested. We want all the light j
we can set, aftd. without taking either side
upon the' question, we otter our columns to
Anybody who Im* anything to say. Let us
hear from Mr. SrxitKs. Can he or can he not |
give good reasons to the people for the course
he has pursued ?
FIREMEN'S CONTEST.
After the very elaborate description in the [
Telegraph ol the Firemen's ii.lit.v-t last Thurs
day, it is only neveasary for us to. announce
the result. One of the companies had to beat

selves creditably, imt, as nobody likes to (w ,

js dated Montgomery, Ala., and comes from a
Well known citizen of this plane, who Is now on

etic taste; but what endears him most to our

NEW DRESS GOODS.
Every man likes to see his wife well dressed, i
and the wives themselves are particularly fond
of dressing well. Fathers, too, dresa their
daughters finely in order to get them husbands
and be rid of the expense as soon as possible.
' These may not be very profound remarks, nor
were they so intended. Nevertheless they
show why it is that Bostick Ac Keim’s Dry
Goods Store is crowded by ladies every day.
Their sales have been so heavy, they inform
us, that their first Spring Stock was soon ex
hausted and they were compelled to send for a
new and elegant supply of Goods, of every
kind, which have just arrived. Consequently
for the last few days there has been a great
throng of ladies at their Store; and to quote
the words of the Senior, (Mr. 8.,) it is really
bewitching to see such lovely creatures, with
faces a’ fresh as a Spring morning and eyes as
radiant as the stars of Heaven, looking with
admiration and delight upon rich Dress Goods,
Robes, Mantillas, etc., as beautiful and varie
gated as the most choice boquet. But we have j
said enough—the ladies in town know more
about Bostick & Rein’s establishment than
we do. Our chief object in penning this para
graph was to call the attention of our fair

i The Spring ha- opened and continued favor-
I able, There has been a tendency in the veget
able kingdom to put forth with unusual steadi
ness and without any check. The oldest in
habitent avers that (up to the present time) it
i is the most propitious Spring time ever known.
| Fields that were sown in wheat, oats and oth
| er email grain last year, and harvested, when
' they have not been grazed, have the appoar
' . ance of having been sow n last Fall, and it'sut-
I sered to grow, will probaidy mature for the
'sickle, either fields, which had been plough-1
' ed in tile mouth of December, are covered with i
weeds. Frnit trees of all kinds have bloomed
profusely. Oom has eome up very regularly, I
. and Cutton. in patches, planted the last of
. ■ March, is coming up; that which was planted
la-t week is vegetating—and the entire crop
will probably lie planted during this week.
Wheat aud oats promise an abundant yield.
On the other hand, it is generally believed that
this profusion of vegetable life is destined to
feed myriads of insects—the fly, grub worm,
boll worm, caterpillar. &0., &c. ['

al counties of this State, will be let to the lowest bid
der by Judicial Districts, at the State House on Tues
day tbe 11th day of May next, at 2 o’clock P. M.—
Any scaled bids which may be forwarded to me by
mail before that time, for’distributing the books in '
any Judicial District, will be considered as bids at ■
the letting out of the contracts. Bonds and security
will be required for the faithful performance of the
contract within a reasonable time to be set by the
Governor; and the money will be paid as soon as tbe
work is done. The contractor will be required to
enter upon the work within ten days after the date of
the contract unless he shall then receive notice ex
tending his time. Any one sending a bid bv mail
must accompany it with tbe certificate of the Clerk of
the Superior Cou t orSherifl’of the county of his res
idence, that he is a responsible person, reliable and
able to give good bond, or such bid will sot be con
