A SERIOUS SHOOTING AFFRAY.
E. Herrman Is Shot Three
Times by Dr. John R. Rose.
A serious shooting affray occurr¬
on the streets of Eastman, near
the Merchants and Farmers Bank,

by Dr. John R. Rose, one ball
the tendon of the heel,
one passing through the calf of
the left leg, touching the bone,
and the other striking a bunch
of keys in Judge Hernnan’s left
pocket, doing no damage except
breaking and bending the keys.
Four shots were fired, but one
failed to take effect.
Immediately after the last shot
•was fired Judge Herrman was ear¬
ned into Dr. J. B. Clark’s drug
store, where medical attention
xvas given to the wounds by I)rs.
Clark and Buchan.
At the time of the shooting
Sheriff Rogers was in the barber
shop across the street, and wit¬
nessed the difficulty 7 '. He at once
ran to the scene of action and
took charge of Dr. Rose, who will¬
ingly surrendered himself and the
weapon with which he did the
shooting. Two warrants were at
once issued against the doctor,one
charging assult with intent to
murder, and the other carrying
concealed weapons, The cases
were brought before Judge C. B.
Murrell for preliminary hearing
Tuesday afternoon at 4 o’clock.
The defendant waived trial, and
after the introduction of evidence
relative to the condition of the
wounded man. bond was assessed
in one case at $1,000, and in the
other at $150. There were several
witnesses to the shooting, but so
far as we have been able to ascer¬
tain there was no one who heard
what passed between them prior
to and during the shooting. They
were passing each other close to¬
gether going in lateral directions
from the angle of t he block. At
this juncture Judge Herrman
states that I)r. Rose applied an
epithet to him and that he con¬
demned it as untrue, whereupon
Dr. Rose began the shooting which
has already been described. He
further states that after the first
shot was fired he protested to the
uuequality of the combat owing
to the fact that lie was unarmed.
J)r. Rose states that the ep¬
ithet in question was applied to
himself; that lie was expectihgau
attack and that Judge Herrman
changed his walking cane from

called upon and justified in using
his pistol. Dr. Rose states that
