Barnesville council still
undecided on Spencer
Hollow variance

“It’s a stickler” was
one of the astute obser
vations made last week
about a variance
request for resi
dential property
in Spencer Hollow,
carried over from
an initial debate at
the June meeting.
The comment was
Bill Claxton’s and a
part of continuing
extensive discus
sion of the possi
bilities and con
sequences of the
council’s eventual
vote.
Discussion also
involved whether
denying the setback
variance would
deem the land
involved “unbuild-
able.” Claxton
also pointed out
that there may be
instances of houses
in Spencer Hollow
that do not comply
with city setback
requirements; and
if house size were
reduced in this
case, it would not
blend in with the
neighborhood -
building “below
standards is not
an option.” The
cul-de-sac area also
is under stipulation
that garages must
have side or back,
not front, entrance-
ways.
Mike Aiken, city
staff person in
charge of building and
zoning code enforce
ment, answered several
questions from the coun
cil and others involved.
Those present included
Joe Sims, real estate
agent, and Phyllis Ab
bott, whose house would
be seriously affected by
granting a variance to
build a house as de
signed in the agreement
between the builder and
the party who already
has bought the prop
erty. Aiken reminded
the council that the city
cannot enforce restric
tive covenants set up by
homeowners’ associa
tions - the city “is only
responsible to enforce
our own zoning require
ments.”
Since the house
is “sold already,”
and several council
members ex
pressed need for
further information
and discussion, a
motion was made
to table the resolu
tion until the next
meeting (either
regular or special
called meeting).

ower seconded;
the motion was
approved unani
mously.
Council also
approved adver
tising a “notice of
holding a general
election on Nov. 2,
2021” to vote for
council positions
in Ward 2, now
held by Hightower;
Ward 4, incumbent
Larry Whitworth,
and Ward 5, now
held by McDaniel.”
Qualifying dates
will be Aug. 16, 17
and 18.
An executive
session was held
to discuss an
anticipated real
estate acquisition.
After the session,
council returned to
open session and
approved autho
rizing the mayor
and acting city
manager to negotiate the
possible sale of about
70 acres near the Ce
dar Grove Landfill, also
with the possibility of
acquiring an additional
10-plus acres. Lamar
County Regional Solid
Waste Authority director
Johnny Poore said the
land sales are needed for
ongoing development of
the energy project and
for buffer areas around
the landfill. Council
approved a resolution
certifying its real estate
discussion complied with
the Open Meetings Law.
