pleaded not guilty, am trying to prove

the murder of rapt. Rankin la to be
Ntrcnythencd by the testimony of
score* of wttnessra. mnrfc of them rela
tive* of the defendant*. Six of the rela-
fenilanl* have bom put on the stand.
Tld Burton and Fred Plnio have not
t cm tilled yet.
Shaky Testimony.
Kith of the defendants remembered
distinctly many persona who were in
their home* the night of the Rankin
murder and recalled many Incident*
that occurred then. Pressed to nunc
person* who were present on othsr
night*, or to recite Inc'dente th*t oc
curred n few day* prior to the mur
der. they said thoy were unable to
do so.
Cross-Examination Ssvsre.
The cross-examination of Attorney
General Caldwell was severe. It dem
onstrated that each witness cbuld re
member nothing that happened op any
other night save tho one that Rankin
was killed. A Mrs. Graney. mother-
in-law of Wad Morris, one of the con
fessed rider*, swore that her son-In
law was In bed In the same room with
her n't 10 o’clock on the nfghf of the
killing and therefor* could not have
i at the mu.der ua he w*y* he was.
She could not recall what time he
ent to bed on any other ulght since
she h-id known him.
Flimsy Evidence.
Sam Baker awore that Herschel
Hogg, another confessed rider, was In
bed with him the n’ght of the killing
of Itankin. Ida memory as to other
night* was vague however, and hi* said
he could not remember whether ho
talked with the lawyers for the defense
last n'ght.
Pathetic 8tory of Aged Mother.
M. V. Reid, father-in-law of Hud
Mottrl*. one of the defendant*, testified
to an allh| for him and denied that
he told a d'fferent story before the
grand Jury. Withered, wrinkled and
poorly clad, Morris* mother. 85 years
old. In a tired, hopeless voice, swore
that her son was at home the night of
the murder. Other witnesses swore
same and the defense Indicated
that It would prove an alibi for each
of the eight men. one by one.
Leader on Stand.
Garrett Johnson, the reputed leader
of the rider*, detailed their movements
tin* n'ght of the Rankin murder.
Johnson swore’the night riders met
nt Marsh’s atom to prevent a raid by
Ukr county men aa detailed by Frank
FChrlnger. Tho sheriff had authorised
them to gather for protection. John-
denied that any one wna masked
that the men gathered there were
night rider*. In fact, he hnd never
seen n night rider and would not know
one If he saw him.
Admits Wearing Matk.
Arthur (Hoar, ono of the defendants,
ndm'tled going masked to ft meeting
called to give a whipping to on al
leged thief. He declared, however,
that the men at the meeting decided
not to act and all went home. He
denied joining th« night riders or go<
Ing on the ride*.
Joe Hogg, father of Herschel Hogg,
one of the confessed night rider*, tes
tified that h'a son. who turned state's
•v'dence, was st home and In bed
asleep on the night of the Rankin mur
der. HerachM Hogg swore that he was
