TO REFORM LEGAL PROCEDURE.
President Taft announced in his recent speech at
go a determined purpose to effect during his
a reform in the administration of justice in the United
States.
It is a laudable ambition and its accomplishment will be
of lasting value to the whole nation.
In view of the president’s natural training and former
public service it was but natural that he should turn his hand
to this great task.
Learned in the law. in the best sense of that often abus¬
ed phrase, and intimately acquainted with American legal
procedure, he is particularly qualified to set in motion the
machinery that will bring about judicial reform.
The present administration of the criminal law in Amer¬
ica is rightly chafacterized by President Taft as a “DIS¬
GRACE TO OUR CIVILIZATION.”
He speaks earnestly on the subject, because he feels
deeply. Me proposes to recommend to congress the crea¬
tion of a commission to study the question with reference to
the federal courts, the report of such commission to furnish
data wf value to the individual states.
Limning the difference between American and English
procedure, President Taft shows it requires ten or twenty
times as long here to secure a conviction, and slight trifling
technicalities are vested with grave importance before ap
ite courts.
The result is thus announced by him;
“The prevalence of crime and fraud, which here is
in excess of that in European countries, is due large
to the failure of the law and its administration to bring
to justice.”
That crime is greater here than in Europe may be ques¬
but the president evidently has authentic statistics to
support his startling and most unflattering assertion.
In the south the evils of legal delays have oftentimes
been unpleasantly apparent in disorder which shocked the

President Taft, in outlining the task for the commission
on judicial reform, particularly emphasizes the following
reforms :
“The prompt decision of cases, reducing the cost of
litigation and opening the courts to the poor as well as the
rich.

perating delays and making legal decisions of some present
value.
“Simpler forms of procedure in both suits at law and in
equity. stem.”

Coming from such a high source and from a man whose
knowledge of his subject cannot be brought into question,
the utterances of Mr. Taft will have a most salutary effect.
