The proviso to this seetnui also evelndea
from the right to\ote for tlelegatt s tfi the

privilege of holding otliee hy an amendment
to the Constitution of the* I'nitcd States,
proposed hy the Thiriy-Ninth Congress,
and known as article. 11.’ The sixth section
provides, “That unt il the people of the said

It is to be observed here that the ipialili
cations of a voter are, hy the lilt h section,
limited to the election of delegates to the
convention nnd to the question whet her such
convention shall or shall not he held, and
that no qualification is declared for a dele
gate so to bn elected ; but by the sixth sec
tion the same qualification as to a voter are
required in all elect inns to any ollin* under
the provisional governments* during llieir
continuance; and as to eligibility at such
elections, certain classes are excluded.

'The fourth section provide* for an elec

The first consideration which requires my
attention upon the puestions us to tho right
to vote, arises upon the registration of vo
ters. 'The question of quamention or dis-
pmlificntion is fixed hy registration. No
power is given to any other board or any
other authority to change the register.—
Persons.whoso names are admitted toregis-*.-

This brings us to tho ilircot questions, Who
are entitled to registration?
First. As toeitizonship and rcsideneo:—
No person is entitled to voto who shall not
he n resident in the State tor ono year pre
vious to the ilny ot election. It is not iieo-

year should exist at the time the person ap
plies for registration. A person in nil other
respects entitled to vote is entitled to regis
tration, although helms not nt thnt tfino

applicant to swear that he has then been a
resident fora year, hut only remdres him to

am of opinion that the phrase “citizen oftlie
State,” us used in the oath, is intended to
include only such persons ns are citizens of*
the United Stales and citizens of tho State,
mid that an alien, who hus not boon made a *
citizen of the United States, cannot safely
