October 30 at Gainesville before
Auditor H. H. Perry. • K:
Effort Now Being Made To Have G.J.&.s.
road sold at fair value.
At a hearing of the Gainesville;
Jefferson and Southern railway
receivership case Monday before
W. A. Charters, judge pro hac vice,
the city of Gainesville filed an
intervention as stockholder and
charged that the Gainesville, Jef
ferson and Southern railroad sold
$161,500 of the first mortgage
bonds for $15,350, or less than 10
cents on the dollar.* The said
transaction is claimed to have been
illegal, unjust and unconscionable,
and a fraud upon^the stockholders,
and that the usury in this trans
action made the deed to secure
the bonds void. It is played that
the deed and the bonds to secure
the same be cancelled not only for
the principal but for eighteen
years’ interest, amounting to
$125,000.
The filing of this intervention
came as a great surprise to the
other litigapts and although the
.whole ease since its inception has
been closely contested at: every
point, it promises now to be a
battle royal. In a nutshell, the
filing of this intervention means
that the city of Gainesville and
the stockholders joining it, are go
ing to make it heroic endeavor to
hjave the road sold at the final ad
judication at a fair and equitable
price and not to allow the Geor
gia railroad, its principal debtor
in the alleged sum of $300,000, and
more to bid it in at whatever price
it pleases. To have the courts set
aside this deed and the bonds to
secure the same would put the to
tal indebtedness at only $300,000,
and this would allow the .people
to organize a local company to
buy it in or else make the success
ful bidder pay what it is worth to
get it. . ' ' ,

So far as known there are no new
developments in the street railway sit
uation. General Warner has returned
from the East where he went to see
about getting the money to* build the
road, but he spent only a short time
here enroute tb Dahlonega and could
not be seen. Therefore, it is not
known whether he got the money or
not. It is rumored that work is to be
gin right away but this could not be
verified.,
