Present, the Honorable Hi a am Warner, Judge
of said Court.
it appearing to the Court by the petition of
Noah R. Fou ler, who sues as such Treasurer, that
on the sixteenth day of May. in the year of Our
Lord Eighteen Hundred and Sixty-one, Grant F.
Edwards, oi said county, made and delivered to
your petitioner, his promissory note of that date,
payaole on demand of your petitioner, aa such
Treasurer, his successor in office, or his or their
order, six hundred dollars, with interest at the
rate of six per cent, per annum, said interest pay
able monthly, for value received, and that alter*
wads, on the same day and year aioresaid, to se
cure the payment of said Instrument, executed
and delivered to your petitioners, as such Treas
urer, giving it the same date, his Dead of Mortg
age, w hereby he conveyed to yonr petitioner, a*
such Treasurer, his successors and assignees for
ever all that tract or parcel of land in the city of
Atlanta, and county of Fulton, being part or lot
number (1) one of sub-division of city lot num
ber (23) twenty-three, bounded west bv Foundry
street, fronting thereoa <.50; fifty feat, soutl \ by*
lot known as Thomas Levy’s lot, north by the lot
known as Thomas Fowler’s lot, containing* quar
ter of an acre, more or less, conditioned that if
said Grant F. Edwards should pay off and dis
charge said promissory note according to its teaor
and effect, thKt then said Deed of Mortgage aha
said note should be void.
And it further appearing that said promissory
note remains unpaid r it is therefore ordered, that
said Grant F. Edwards pay into this Court by the
first day ot the next Term thereof, the principal,
interest, and cost due on said promissory note,
to-wit: fifty one dollars, besides interest, or show
canse to the contrary, if there be any: and that on
failure of taidGrant F. Edwards so.todo, the equity
of redemption in and to said mortgaged premises
be forever thereafter barred and foreclosed.
And it is further ordered, that this Rale be pub
lished in the Atlanta Opinion, once a montn for
tour months, or a copy thereof served on tho said
Grant F. Edwards, or his special agent or attor
ney, at least three months beforethe next Term of
this Coart.

I T being shown that William Morgan and Henry
C, Hunter, two of the defendants in the above
stated ease, reside beyond the limits of this State
so that they cannot beserted by the Sheriff: It is
ordered that said defendant be served by publica
tion ol this Order once a month for four months
previous to the next Term of this Court, in the
Opinion, a newspaper published in the city of At
lanta, and that saiu William Morgan and Henrv
C. Hunter appearand defend said bill at the next
Term of the Superior Court for said county of
w alker, on the 4th Monday in February, 1HW, or
that in detault thereof the bill will be taken as
confessed, and the complainants be allowed to
proceed et& parts to said defendants.
