Rev. Marlon Capps, a former Metho
dist preacher, has filed an appeal 11
to the State Supreme Court from a
sentence of death Imposed upon him
by a Sebastian County jury. He was
convicted of burning to death three j
of his children. Evidence at the trial
was that the children were tied in I
bed, which was saturated with oil, 11
and the hoime fired.
Capps was convicted on the testi
mony of two elder children, who es
caped, but who, it alleged, have
sinoe declared they swore falsely ||
against their father.
