of Cartersville,
Judge Branham showed that Mr.
James was a traveling salesman and
that he was absent m Mississippi,
but that a subpoena had been left at
his mether's home on March 28th.
and that he had kept the wires hot
between Rome and some po nt in
Mississippi, trying to get Mr. James
| here for the trial to lay.
Judge Branham admitted how
ever that his “wire-work” had in
this branch of the ea»e, proven
futile,
Solicitor General Nunnally, in
reply stated that the defence had
made an effort at a continuance
of this cass in last November on
the grounds of the ab-scence of thi 8
same James (D) witness and be
sides, that the defense at this form
nad not made the prescribed ef
ort, to have said witness here,
for that effort to be sufficient

Judg« Henry said that he did
net care to hear from the state on

Maddox lor his argument
on the other ground, viz: why the
case should be continued on ac •

Judge Maddox then asked foi

this was met by Col. Watt Harris of
the state side. Col Harris argued that
so for as witnesses w ere concerned
that both sideo were ready, and
that he and his clients were here at
thier own expense and that Solicitor
Nunal.y informed him that among the
witnesses were many who lived out
of the county and were here at heavy
expense to the countv.
Judge 11-nry, in passing on the
case took occasin to say that it was
the intention of the Law to hasten
all this class of cases that the inocent
might be vindicated at once and that
Justice might be meted out to the

draw 100 Jurors from the Jury
box and ordered Sheriff Moore to

The defendant, Frank Wilker
son the murderer of Free Steuben*
was iu court and looked corsidera
bly more worried than he did dur
ing the trial a year ago.
Mrs, Stephen?, the wife of the
murdered man, and paramour ®f
the defendant is somewhere in the
far North West and will not be
present to testify.
The court room this morning J

to hear the evidence in the case.

There is several little coincidents
connected with the new council. For
the fiiet time the First ward will be
represented by two “Buds* 1 There
will be four Mc’s in the eouneil and
three “Billies*' The mayor is Secre
tary and treasurer of a Building and
Loan Association, while the council
is composed «f three merchants two
’awyers one miller, one baker, one
“m< d. cine man “ one mechanic aid
one capitalist. It is doubtful if such a
combination ever existed before.
This calls to mind the councils of
the past which The Hubiler after
some little trouble has secured.
The first Mayor after the war was
James Noble who «erved in that ca
pacity in 1865.
In 1866 Dauiel S. Pi intap was
mayor, and the following were his
couacilmen, Jesse Lambutb, T, J.
Pe ry, Samuel G.bbon-, J. H.Coopsr

Smith was Clerk.
In 67-GB, Chas. H. Smith (Bill
Arp) was mayor and Messrs Lam-

Hood, J. W. Hooper Jr. and J. C.
Pemberfoe were councilman.
Major. Z. B. Hargrove was mayor
in 69. In that year T. J, Perry, C. H
Smith, J. C. Rawlins, Jas. Nobb, J
M. Crogory and J. J. Cohen were
die councilmen.
In 1873, Major W - F, Ayers was
mayor and G. AV. Holmes, T. Mc-
Guire, R. V. Mitchell, W. L. White

men, Henry Norton was Clerk.
Major Ayer was also mayor in 71
and had with him the following

In 18/6—The council was com

clerk. This was the council that
issued the b >nds which are soon to |
be redeemed.
In 1877—T W Alexander, re
mained as mayor, with the same
council except that. Messrs. Frank
Woodruff and VV F Ayer succeeded
M'-asrs Dailey and Meakin.
