that this letter to Jefferson Davis hud

ing his high appreciation of Mr. Cushing’s
legal attainments, resolved to withdraw
his name, apprehensive that his opinions,
as expressed in tbe past, might injurious
ly affect tbe decisions of the Supreme
Court, iu the event of his confirmation as
Chief Justice.
The President called un extra cabinet
meeting to-day, which continued for near
ly two hours, duriug which the subject of
the Chief Justiceship was considered.
A short time before the President’s
private secretary started for the Capitol,
a long letter from Mr. Cushing, through
Gen. Butler, was received by the Presi
dent, in which tbe writer thauks the Pres
ident for his kindness and partiality in
nominating him for the great offico of
Chief Justice ; aud an if in contradiction
of the rumors mid charges against him
from newspapers and other sources, he
expresses his conviction on tho propriety
of the several amendments to the Con
stitution, added since the lute civil war;
and in conclusion, ho asks that his nom
ination be withdrawn from the Senate.
The President detained the private sec
retary and added to the message of with-
drawal u postscript, stating that since the
message was written yesterday he had
received a letter from Mr. Cashing, n
copy of which he enclosed, deeming it an
act of justice to that gentleman to lay
tho same before the Senate.
As soon as the postscript was written,
tho private secretary left the Executive
Mansion for the purpose of delivering tho
message to tho Souate.
The message is accompanied by Cushing’s
letter to Jefferson Davis, as the ground
on which the nomination is withdrawn ;
