attached for 100 bales of cotton, and
on acceptance of that draft we give
up the bill of lading, and the party
accepting tho draft fails to pay it at
maturity, can party from interior
hold us for amount of draft, we
charging no commission for collect

lecting, can they hold us for amount

as to due dilligenee to be determined
in each case by the circumstances
thereof. Two or three years ago a
Hour dealer in Richmond sold to a
customer in Philadelphia several bills
of‘'shorts,”drawing at sight there
for and pinnSßg the bill of lading to
the draft, deposited the papers
in his own bank, the draft usually
going to his own credit, and tin- Rich
mond bank forwarding the same to
Philadelphia for collection. The
Philadelphia bank then collected the
draft and gave the lull of lading to
the drawer. After several such trans
actions), the buyer wrote to the seller
requesting him to draw at one day'-.

being sent in the same way without
instructions.
The Philadelphia bank, upon then

decided that the Philadelphia bank
had no right, under tin- circum

bank has some reason to infer that a
separation of the tw o papers is de
sired or authorized by the drawer or
his immediate agent, it should insist
on payment or security before deliv
ering the title to the property repp
