Gentile property

to the IPC.
"Due to a technical issue based on
Article 11 of the Comity Zoning Ordi
nance," said Hainley, "staff is recom
mending that you remand this appli
cation back to the Island Planning
Commission."
Commissioner Tom Sublett (Dist. 2)
made a motion to send the item back,
which was passed unanimously.
After the meeting, Hainley explained
that Article 11, which was enacted
about a year and a half ago, requires
the county's two planning commission's
three options when acting on an appli
cation:
• Approve;
• Approve with conditions;
• Deny; or
• Defer
At the IPC's December 16 meeting,
a motion to approve Gentile's applica
tion was made and seconded but was
defeated on a 3-4 vote.
According to Article 11, at that point
the IPC should have entertained and
passed a motion to deny the applica
tion, but failed to do so.
According to reports, the large crowd,
who were mainly opposed to the appli
cation, became very loud in celebrating
Gentile's denial.
IPC chairman Preston Kirkend-
all tried, without success to quiet the
crowd and restore order. When that
failed he adjourned the meeting.
It is not clear why the IPC did not
follow up with a motion to deny the
application.
Gentile owns a 14 acre tract on the
southeast comer of Frederica Rd. and
Soth Harrington Lane on the north end
of St. Simons Island.
According to the Planned Develop
ment Zoning Text for the property,
which was approved more than a year
ago with no opposition, the property is
split roughly in half, with half being
commercial and half being mixed use
residential.
In brief, Gentile's amendment would
have increased the commercial portion
of the property and reduced the resi
dential portion.
The amendment was met with very
much opposition, primarily from resi
dents on the north end of the island
who thought the shopping center it
would have allowed would be too much
for the area.
There were concerns about increased
traffic, noise, impact on property values
and degradation of island aesthetics
and the quiet nature of the area.

During their Dec. 2 meeting, the
County Commission approved all the
alcoholic beverage license renewals for
2011, except for R Bar and Grill on
Altama Ave. which caused some con
cerns with the commissioners.
Police Chief Matt Doering told the
commission that when R Bar owner
Prafullaben Patel was granted his
license he was told the business had to
be a restaurant due to its proximity to
a residential area.
Doering said Prafullaben stood before
the commission and said he understood
the conditions of his license.
"The owner told you exactly what he
would do with the place," said Doering,
"he said it to you standing right here."
Doering said he had received com
plaints about the R Bar, so on Wednes
day Dec. 1 he sent an undercover offi
cer in the bar to try to order food.
Doering said the officer was told R
Bar did not sell or serve food, but he
could order it from a nearby restau
rant that would deliver it to the R Bar
where he could eat it.
Doering said R Bar was nothing
more than a dance bar. He said it only
had about 12 stools around a U-shaped
bar, not the required 25 seats for the
restaurant. Doering said the bar had a
dance floor and a disc jockey booth.
Doering said there were two issues,
one was whether to renew the license
for 2011 and the other was whether to
revoke his 2010 license.
Doering mentioned revoking the
license because the owner is in viola
tion of the county ordinance every day
that he is open.
Commissioner Don Hogan (At Large
#1) moved to revoke the 2010 license
and not renew for 2011.
County Attorney Aaron Mumford
told the commission they could deny
the renewal but in order to revoke Pra-
fullaben's current license they would
have to give him due process.
Due process, according to the
county's alcoholic beverage ordinance
means the commission must give the
owner two weeks notice prior to hold a
revocation hearing.
Mumford said the commission could
have the hearing at their Dec. 16 meet
ing and revoke the license at that time,
after the hearing, if they chose.
"But," said Mumford, "according to
your ordinance, you must give him the
opportunity to be heard. And you can
cite him for being in violation of the
ordinance."
Howard Lynn was not happy with
Mumford's advice.
Lynn said, "This gentleman has bla
tantly violated our ordinance. He has
ignored what we told him he must do
when we gave him his license."
Hogan agreed with Lynn saying
Prafullaben was "strictly in violation"
and was "doing it intentionally."
But, Hogan withdrew his motion.
Doering said he intended to write
Prafullaben a ticket for being in vio
lation on Dec. 2 and for every night
thereafter that the bar is open and
serving alcohol in violation of the law.
"He can chose not to sell alcohol,"
said Doering.
Still unhappy, Lynn wanted a way
to revoke alcoholic beverage licenses
when the business is in violation.
Mumford said he may be able to
write an amendment to the ordinance
giving the commission to temporarily
suspend a license pending the revoca
tion hearing.
Mumford said that the only way the
commission revoke the license immedi
ately was if the bar was causing severe
injury to the public health.
"I can't say right now," said Mum
ford, "that there is an immediate risk
to the public health and safety because
this bar is not serving food, even though
it is a violation of the ordinance."
Doering said he would send a letter
to Prafullaben the next day notifying
him of the violation and revocation
hearing.
Hogan continued to agree with Lynn
saying, "An alcoholic beverage license
is a privilege, not a right and this one
out to be pulled. They should not have
a right to appeal."
Commissioner Jerome Clark offered
a second motion to accept Mumford's
recommendation to defer the revoca
tion to the Dec. 16 meeting and deny
the renewal of the 2011 license.
The motion passed 4-3.

abandonment of an alley on East Beach

GICA robotics team
qualifies for world
championships
Representing the Golden Isles Career
Academy, Team Pegasus Robotics had
five teams representing the charter
school's Engineering-Robotics Program
in the VEX Robotics Round-Up Tourna
ment at the Georgia TSA Fall Leader
ship Conference at Sea Palms Resort on
St. Simons Island.
Forty one robotic teams from
throughout Georgia participated in the
Conference. From the qualifying rounds
eight three team alliances participated
in the finals for the Top Robotic Teams
in Georgia.
Four Team Pegasus teams repre
sented Glynn County in the VEX Robot
ics Round-Up Tournament Finals.
Teams 1333B and 1333 won first
and second place respectively in two
rounds. Team Pegasus 1333D and
1333C were defeated in the quarter
finals.
Team 1333B beat Dunwoody High
for the first place honor and Team 1333
won second place over Lowndes High
School.
The Teams are preparing for the six
remaining tournaments which start
January 22, 2011 at Lowndes High
School. The Final World Champion
ships will be held in Orlando during
April 2011 with over 800 teams com
peting. Team Pegasus has set their
goal of finishing in the top 10 in the
world.
In order to raise money for the trip
to the Final World Championships in
Orlanda, Team Pegasus will host a
series of luncheons at GICA on Dec. 9,
Jan. 20, Feb. 17 and March 17.
The $8 a plate dinners will feature
a half pound of Georgia Sweet White
Breaded Shrimp from King and Prince
