Athens man gets 18 months for theft
An Athens man was sentenced
recently in Madison County
Superior Court to a year and a
half in jail on theft charges.
Otis McIntosh, 46, was sen
tenced to 18 months confine
ment on felony charges of theft
by taking and theft by receiving.
He was also sentenced to eight
years and six months proba
tion. Charges of for violation of
Georgia’s Controlled Substance
Act (VGCSA) — possession of
cocaine and possession of tools
for the commission of a crime
were dismissed.
Other actions filed recently
in the office of the Clerk of
Superior Court of Madison
County include:
•Darrell Eugene Wallace,
37, Royston, was sentenced to
five years probation and fined
$2,025 for VGCSA — pos
session of methamphetamine.
Charges of inmate’s possession
of drugs or weapons, marijuana
(less than an ounce) and two
counts of VGCSA — purchase,
manufacture or distribution of
a controlled substance — were
dismissed.
•Dexter Rashad Swain, 22,
Hull, was sentenced to five years
probation and fined $1,130 for
possession of hydrocodone. A
charge of drugs not in original
container was dismissed.
•Debra L. Smith, 49, Elberton,
was sentenced to seven years
probation and fined $522 for
theft by taking (reduced from
burglary). Charges of VGCSA
— possession of methamphet
amine and possession of tools
for the commission of a crime
were dismissed.
•George Willie Jarrells, 64,
Athens, was sentenced to seven
years probation and fined $1,150
for possession of cocaine.
Charges of inmate’s possession
of drugs or weapons, driving
while license suspended, DUI
and weaving were dismissed.
•Kimberly Fleming, 54,
Commerce, was sentenced to
seven years probation and fined
$1,150 for possession or pur
chase of cocaine,
•William Jason Elrod, 31,
Colbert, was sentenced to eight
years probation and fined $850
for theft by taking. Charges of
theft by taking, burglary, eight
counts of criminal damage to
property in the second degree
and six counts of unlawful
dumping were dismissed.
•Henry Clinton Elder, 47,
Watkinsville, was sentenced to
five years probation and fined
$522 for theft by receiving sto
len property.
•Phillip Ashley Casey, 29,
Jefferson, was sentenced to 10
years probation and fined $ 1,475
for burglary. A second charge of
burglary and a charge of posses
sion of tools for the commission
of a crime were dismissed.
•Marty Lamar Bird, 39,
Commerce, was sentenced to
two years confinement and three
years probation for interference
with government property and
obstruction of officers. He was
also sentenced to two years con
finement and six years proba
tion for VGCSA and one year
confinement for driving while
license suspended. Charges of
possession of a schedule n con
trolled substance, possession of
less than an ounce of marijuana
and two counts of possession of
drugs not in original container
were dismissed.
•David Keyros, 48,
Danielsville, was sentenced to
10 years probation for theft by
taking (reduced from burglary).

in the first degree. He was also
fined $2,550. A charge of theft
by taking was dismissed.
•Roger Davis Smith, 33,
Royston, was sentenced to one
year probation and fined $668
for theft by taking (reduced from
forgery in the first degree).
•Daniel Clark Neal, 26,
Maysville, was sentenced to
one year probation and one day
confinement for DUI-drugs and
one year confinement for speed
ing. He was also fined $1,021.
Charges of driving while license
suspended or revoked, giving
false information to law officers
and three counts of endanger
ing a child by driving under the
influence were dismissed.
•Jeffery Smith, 28,
Danielsville, was sentenced to
one year probation and fined
$472 for disorderly conduct.
•Kathryn Ivey Davis, 48, Hull,
was sentenced to one year pro
bation and fined $387 for pos
session of drug-related objects
(reduced from possession of
tools for the commission of a
crime). A charge of possession
of cocaine was dismissed.

31 foreclosures advertised
for November sale date
Thirty-one Madison County prop
erties are being advertised in The
Madison County Journal for the
November foreclosure sale, down
from 35 in October, 37 in September
and a record high of 50 for August.
Through the first 11 months of
2009, 327 foreclosures have been
advertised in The Madison County
Journal.
In 2008, there were 260 foreclo
sures advertised, up from 150 in both
2006 and 2007. At the current pace,
Madison County will end 2009 with
356 foreclosures advertised. While
the foreclosure sales are advertised
in the newspaper, not all homes will
necessarily be sold through the fore
closure process. Mortgage holders
could still settle with lenders before
the property is sold at the courthouse
steps.
City of Carlton
Election
Those qualifying for the offices of Mayor
and City Council Members for the Carlton
Municipal Election to be held on
November 3, 2009 include:

Joey Cash
Each candidate qualified as the only
candidate for their respective office with no
opposition. The Georgia Election Code
Annotated Section 21-2-291 (Procedure as
to unopposed candidates) states that "in
the event there is no opposed candidate in
a precinct in a special or general election,
no special or general election shall be held
in such precinct." Furthermore the section
states that "each such unopposed
candidate shall be deemed to have voted
for himself or herself." Based on the
referenced code section, a City of Carlton
General Election will not be held on
November 3, 2009.
