By virtue of Power of Sale contained
in the Security Deed from Michael J.
Prewett (hereinafter referred to as
'Debtor') to Bank South, N.A.
(hereinafter referred to as “Grantee")
dated October 28, 1992, recorded in
Deed Book 998, Page 586, Houston
County. Georgia records (said Security
Deed being hereinafter referred to as the
"First Security Deed’) and in the
Security Deed from Debtor to Grantee
dated October 28, 1992, recorded in
Deed Book 998, Page 588, Houston
County, Georgia records (said Security
Deed being hereinafter referred to as the
“Second Security Deed") (the First
Security Deed and the Second Security
Deed being hereinafter collectively
referred to as the ’Security Deeds'),
said First Security Deed being given to
secure a Commercial Promissory Note
dated October 28, 1992, in the original
principal amount of Two Hundred
Thousand and No/lOOths Dollars
($200,000.00), with interest from the
date thereof at the rate specified therein
(said Commercial Promissory Note being
hereinafter referred to as the “First
Note"), and said Second Security Deed
being given to secure a Commerical
Promissory Note dated October 28,
1992, in the original principal amount of
One Hundred Ninety-Seven Thousand
and No/lOOths Dollars ($197,000.00),
with interest from the date thereof at the
rate specified therein (said Commerical
Promissory Note being hereinafter
referred to as the “Second Note") (the
First Note and the Second Note being
hereinafter collectively referred to as
the “Notes"), together with any and all
other indebtedness owing by Debtor to
Grantee, there will be sold by the
undersigned at public outcry to the
highest bidder for cash before the
Courthouse door at Houston County,
Georgia, within the legal hours of sale on
the first Tuesday in March, 1994, the
following described property:
All that tract or parcel of land more
particularly described on Exhibit “A“
attached hereto and incorporated herein
by reference thereto.
TOGETHER WITH all of toe following:
(i) all buildings, structures and other
improvements located thereon or on any
part or parcel thereof and all fixtures
affixed or attached, actually or
constructively, thereto; (ii) all and
singular the tenements, hereditaments,
easements and appurtenances
belonging thereunto or in any wise
appertaining thereto and the reversion
and reversions, remainder or remainders
thereof; (iii) all rents, issues, income,
revenue and profits accruing therefrom;
(hr) all accounts and contract rights
arising in connection with any part or
parcel thereof or any buildings,
structures or improvements located
thereon, including without limitation all
accounts and contract rights in and to
all leases or undertakings to lease
affecting the land or any buildings,
structures, or improvements thereon;
(v) all minerals, fiowers, crops, trees,
timber, shrubbery and other emblements
located thereon or thereunder or on or
under any part or parcel thereof; (vi) all
estates, rights, title and interest therein,
or in any part or parcel thereof; (vii) all
equipment, machinery, apparatus,
fittings, fixtures whether actually or
constructively attached thereto and
including all trade, domestic and
ornamental fixtures, furniture,
furnishings and all personal property of
every kind or description whatsoever
located thereon, or in or on the
buildings, structures and. other
improvements thereon, and used in
connection with the operation and
maintenance thereof, and all additions
thereto and replacements thereof; and
(viii) all building materials, supplies,
goods and equipment delivered thereto
and placed thereon for the purpose of
being affixed to or installed or
incorporated or otherwise used in the
buildings, structures or the
improvements located thereon or any
pah or parcel thereof.
EXHIBIT "A"
All that tract or parcel of land situate,
lying and being in Land Lot 122 of the
sth Land District of Houston County,
Georgia containing one acre of land,
more or less, and being more particularly
described according to a plat entitled
'Property Survey for Patricia Swift*
prepared by Waddle-Clements &
Associates dated March 28, 1985 and
recorded in Plat Book 27, Page 294,
Clerk's Office, Houston Superior Court.
Said tract of land has the metes, bounds
and dimensions as shown by said plat
which by this reference is made a part
hereof.
This is the same property described
in a deed of record in Book 613, Folio
134, Clerk's Office, Houston Superior
Court
The property is known as 2764
Watson Boulevard, Centerville, Georgia.
The indebtedness secured by the
Security Deeds has been and is hereby
declared due because of default under
the terms of said Notes and Security
Deeds including, but not limited to, the
nonpayment of principal and Interest
when due. The indebtedness remaining
in default, the sale will be made for the
purpose of applying the proceeds
thereof to the payment of the
indebtedness secured by the Security
Deeds, accrued interest and expenses
of the sale and all other payments
provided for under the Security Deeds,
including attorneys' fees as provided in
the Notes and Security Deeds, notice of
intention to collect attorney's fees
having been given as provided by law;
and the remainder, if any, shall be
applied as provided by law.
Pursuant to the terms and conditions
of the Security Deeds, Lender has
provided written notice of the default
referenced hereinabove and an
opportunity to cure such default to Irene
Underwood and E. Thomas Stroud and
such default has not been cured.
Grantee hereby acknowledges that
the deed to secure debt from Irene
Underwood and E. Thomas Stroud to
Grantee dated October 6, 1986, and
recorded in Deed Book 738, Page 163,
Houston County, Georgia records has
been or wiN be satisfied of record.
To the best of Grantee's knowledge,
the party in possession of the aforesaid
property is Irene T. Underwood
(“Underwood*) pursuant to that certain
Warranty Deed dated July 21, 1993,
recorded in Deed Book 1037, Page 69,
Houston County, Georgia records.
Said property will be sold as the
property of Underwood (successor-in
interest to Debtor) subject to all unpaid
real estate ad valorem taxes and
governmental assessments and to all
prior restrictions, rights-of-way, and
easementß of record, if any, appearing
of record prior to the date of the Security
Deeds and those appearing after the
date of the Security Deeds and
consented to by Grantee.

performance of the terms and Conditions
of that certain security deed executed
by WILLIAM T. ARNOLD to
ADMINISTRATOR OF VETERANS
AFFAIRS, dated September 2, 1977,
and recorded in Deed Book 507, Folio
384, in the Office of the Clerk of the
Superior Court of Houston County,
Georgia to secure a note in the original
principal sum of $27,500.00, and default
haying been made in the payment of
said indebtedness, and the entire
remaining unpaid indebtedness being

delivery of materials in specifying

upon deposit of $50.00 per set. No
refund will be made.
The successful bidder will be
furnished, free of charge, six sets of
