The said named parties and any and all
other persons known and unknown claiming
any right, title, power, interest, ownership,
equity, claim or demand in and to the lands
hereinafter described, and all occupants,
tenants, lessees, licensees and all holders,
owners and users of ways and easements
in, across, over and under said land are
hereby notified, under provisions of the
Official Code of Georgia Annoted §32-3-4
through 32-3-19, providing for toe exercise
of the power of eminent domain by the
State of Georgia, or any of its subdivisions,
or by any county of such State as follows:
That the above-stated case, being a
condemnation in rem against the property
hereinafter described, was filed in said
Court on the 25th day of April, 1994;
That in accordance with toe provisions
of the aforesaid Official code of Georgia
Annotated, a Declaration of Taking, duly
authorized and properly executed as
provided by said Code, has been made
and file in said case, declaring the necessity
for and exercising the power of taking the

same in the City of Warner Robins, Georgia;
and in pursuance of such authority, the City

County Fourteen Thousand Nine Hundred
and No/100 ($14,900.00) Dollars as the
just compensation for toe lands described;
and all persons claiming such fund or any
interest therein, are hereby required to
make known their claims to the Court;
In accordance with the provisions of
said Code the Plaintiff/Condemnor has
prayed the Court forimmediate possession
of said property and all persons having any
interest in or claim against such property,
as above set forth, are required by the
Order of toe Judge in Houston Superior
Court, made and filed in said case on the
25th day of April, 1994, to show cause
before such Judge at toe Houston County
Courthouse on toe 22nd day of June, 1994,
at 10 o’clock A.M. why such prayers for
immediate possession should not be
granted.
That in accordance with the Official
Code of Georgia Annotated §32-3-13
through §32-3-19, if toe owner, or any of
the owners, or any persons having a claim
again st or interest in said property, shall be
dissatisfied with the compensation as
estimated in toe Declaration of Taking and
deposited in Court, such person orpersons,
or any of them, shall have the right, at any
time subsequent to the filing of the
Declaration and the deposit of funds into
Court but not later than thirty (30) days
following the date of service as provided for
in the Official Code of Georgia Annotated
§32-3-8 through §32-3-10, to file with the
Court a notice of appeal, toe same to be in
writing and made a part of toe record in the
proceedings.
The said property, as thus affected, is
described in Appendix “A” to Exhibit “A” of

ORDER
WHEREAS, The City of Warner Robins,
in conjunction with the State Department of
Transportation, has completed plans to
expand and relocate the location of Corder
Road (County Road # CSS3O) from Watson
Boulevard SR247C to 380 feet west of
Pineview Drive for a total distance of 0.6
miles, said project being more fully shown
on a map and drawing on file in toe office of
the Department of Transportation, No. 2
Capitol Square, Atlanta, Georgia; and
WHEREAS, in order to maintain the
projected scheduled of road construction
of the Department of Transportation, it is
necessary that the right-of-way and other
rights fortoe construction of said project be
acquired without delay; and
WHEREAS, parcels of land upon which
right-of-way and/or construction easement
is required is shown on Annex 1, attached
hereto, said property shown of record as
being owned by L. DARLENE JOINER
BACK and JIMMY JOINER.
NOW. THEREFORE, IT IS ORDERED
by toe Mayor and Council of toe City of
Warner robins, Georgia, that the
circumstances are such that it is necessary
that the right-of-way and/or construction

order by acquired by condemnation under
toe provisions of toe Official Code of Georgia
Annotated §32-3-4 through 32-3-19; and
IT IS FURTHER ORDERED that the
City Attorney shall proceed to acquire the

annex by condemnation under the
provisions of said Code, and the City
Attorney is further authorized and directed
to file condemnation proceedings, including
a Declaration of Taking, to acquire said
interest in said lands and to deposit in the
Court the sum estimated as just
compensation, all in accordance with the
provisions of said Code.
IT IS FURTHER ORDERED that
Henrietta Mclntyre, Acting Mayor and
Clayton P. Mays, City Clerk, are authorized
to execute thi s order on behalf of the Mayor
