Under and by virtue of the Power of
Sale contained in a Security Deed given
by Robert B. Tillery and Donna P. Tillery to
Collateral Investment Company, dated
October 26,1978, recorded in Deed Book
538, Page 350, Houston County, Georgia
Records, as last transferred to AmSouth
Mortgage Company, Inc. by assignment
dated December 31, 1986, recorded in
Deed Book 752, Page 369, Houston
County, Georgia Records, conveying the
after-described property to secure a Note
in the original principal amount of THIRTY
TWO THOUSAND SEVEN HUNDRED &
NO/100 DOLLARS ($32,700.00), with
interest thereon as set forth therein, there
will be sold at public outcry to the highest
bidder for cash before the courthouse
door of Houston County, Georgia, within
the legal hours of sale on the first Tuesday
in September, 1994, the following
described property:
EXHIBIT “A"
All that tract or parcel of land situate,
lying and being in Land Lot 194 of the Fifth
Land District of Houston County, Georgia,
known and designated as L0t256, Section
2, of a subdivision known as Pine Valley,
according to a map or plat of survey of said
subdivision prepared by James W. Sherrill,
Surveyor, dated December, 1961, a copy
of which is of record in Map Book 7, Page
240, Clerk’s Office, Houston Superior
Court. Said plat and the recorded copy
thereof are hereby made a part of this
desciption by reference thereto.

improvements are located on said
described property.
The above-described property is
conveyed subject to Restrictive Covenants
as contained in instalment of record in
Deed Book 190, Pages 92-96, Clerk’s
Office. H-uston Superior Court; also,
subject to an easement for drainage
purposes over, upon and across the
westerly ten (10) feet of said property as
shewn on the aforesaid recorded plat of
survey.
Also includes: range, venthood,
dishwasher, energy package including
heat pump, and garbage disposal.
The debt secured by said Security
Deed has been and is hereby declared
due because of, among other possible
events of default, failure to pay the
indebtedness as and when due and in the
manner provided in the Note and Security
Deed. The debt remaining in default, this
sale will be made for the purpose of paying
the same and all expenses of this sale, as
provided in the Security Deed and by law,
including attorney’s fees (notice of intent
to collect attorney's fees having been
given).

indebtedness, secured by a Security Deed
executed by Douglas Turner and Marva G.
Turner to Georgia Federal Bank, FSB, dated
the 26th day of August, 1988, and recorded
in Deed Book 817, Page 413, Houston
County, Georgia Records, the undersigned,
First Union National Bank of Georgia,
successor in interest to Georgia Federal
Bank, FSB, pursuant to said deed and the
note thereby secured, has declared the
entire amount of said indebtedness due
and payable and pursuant to the power of

Sale contained in the Security Deed from
Theron Monroe Moore to Bank South.
Houston County, N.A., dated December
30,1986 and recorded in Deed Book 751,
Page 565, in the offices of the Clerk of the
Superior Court of Houston County, Georgia,
as subsequently amended by instrument
dated December 8,1987 and recorded in
Deed Book 790, Page 358, aforesaid
records (the “Security Deed"); and pursuant
to the provisions contained in that certain
Order modifying the automatic stay of 11
U.S.C. Section 362, dated July 26, 1994
and entered in Chapter 7 Case No. A 94-
65567-JEM, United States Bankruptcy
Court, Northern District of Georgia, Atlanta
Division, the undersigned will sell at public
outcry to the highest and best bidder for
cash before the door of the Courthouse of

is evidenced by a renewal Commercial
Promissory Note from Theron Monroe
Moore to Bank South, Houston County,

principal amount of $70,000.00 and, by
virtue of the open-end provisions contained
in the Security Deed, a Commercial
Promissory Note from Theron M. Moore to
Bank South, N.A., dated May 12, 1992 in
the original principal amount of $48,942.06,
and a Commercial Promissory Note from
Theron M. Moore to Bank South, N.A.,
dated July 30,1992 in the original principal
amount of $19,000.00 (collectively the
“Notes"), plus interest from date on the
unpaid balance until paid, and other
indebtedness.
Default has occurred and continues
under the terms of the Notes and Security
Deed by reason of, among other possible
events of default, the nonpayment when
due of the indebtedness evidenced by the
Notes and secured by the Security Deed
and the failure to comply with the terms and
conditions of the Notes and Security Deed.
By reason of this default, the Security Deed
has been declared foreclosable according
to its terms.
The above-described real property will
be sold to the highest and best bidder for
cash as the property of Theron Monroe
Moore, the proceeds to be applied to the
payment of said indebtedness, attorneys'
fees, and the lawful expenses of said sale,
all as provided in the Notes and Security
Deed. The sale shall be subject to the
following: all outstanding ad valorem taxes
and/or assessments, if any; possible
redemptive rights of the Internal Revenue
Service, if any; and all prior assessments,
easements, restrictions or matters of record.

presently owned by Theron Monroe Moore.
