Law For The People
Un-Insured And Under-Insured Motorist
Coverage Helps Wrongful Death Victims
By Attorney Chadrick Mance
Rodney has no car insurance nor do any members of his household. A earless
driver kills Rodney. The driver has $25,000 in automobile liability insurance. Before dy
ing, Rodney accumulates $50,000 in medical bills. Rodney’s sons and wife hire a lawyer
to recover a large monetary amount for his death. Can Rodney’s lawyer recover this large
amount? No, Rodney’s lawyer is limited to the $25,000 in liability coverage. Rodney is the
victim of no un-insured or under-insured motorist (“UM”) coverage.
This is why. First, Rodney’s family lacks the insurance coverage to collect a large
verdict or settlement against the at-fault driver. Second, Rodney’s family must pay medical
bills that UM insurance would have otherwise paid. Third, Rodney’s family cannot secure
justice for his death.
Rodney’s family should have considered purchasing automobile insurance with
UM coverage. By law, every insured driver must have at least $25,000 in UM coverage
unless he rejects it in writing. This can be added onto the liability insurance of the at-fault
driver when the injured driver’s losses exceed the at-fault driver’s insurance coverage. UM
coverage insures family members residing in the same house in cases like Rodney’s.
Consider this. If a careless driver with only $50,000 in liability insurance kills a
person who lives in a household with 2 cars (1 owned by himself and the other by his wife )
each with $25,000 in UM coverage, the injured person has $100,000 in insurance for his
wrongful death case: $25,000 for each car plus $50,000 in liability coverage. UM coverage
can turn a wrongful death case from one with minimum recovery to one with $100,000 in
recovery. Although your family may not experience a wrongful death, you need UM Insur
ance just in case.
This article touched the surface of UM coverage for wrongful deaths. So, it is
important to speak with a wrongful death lawyer in a wrongful death case.

Mance Law Group at 912.574.4LAW (4529).
