Right to vote more a state issue than federal
Dear Readers, Last
we week we learned
that a Georgia judge,
Fulton County Superior
Court Judge T. Jackson
Bedford, Jr., ruled Georgia’s
voter ID law unconstitution
al on state grounds. In look
ing at the history of federal
constitutional we further
learned that the right to vote
is actually more an issue of
state law than federal law
- which would be consistent
with Judge Jackson’s ruling.
We also saw how the right
to vote, a fundamental right
for any citizen, has been a
blot on our history, in terms
of fairness and equality.
I had mentioned, in pass
ing, that there was some fed
eral litigation and that U.S.
District Court Judge Harold
L. Murphy had twice delayed
enforcement of the voter ID
for being a “poll tax.”
This term, “poll tax,”
describes state laws designed
to frustrate a citizen’s right
to vote, essentially based on
race.
It was only one of several
practices used to do this and
was used to deny a citizen
the right to vote for failure
to pay a tax or fee (hence,
the term “poll tax”).
There are all other kinds
of variations on the same
theme (like denying the right
to vote to the illiterate) - all
designed to deny slaves, and
their descendants, freed by
war and bloodshed, the right
to vote guaranteed by the
Civil Rights Amendments of
1870.
This practice continued
for almost a century, when
the issue was squarely faced
during the second civil rights
upheaval in the 19605.
Thus, finally, in 1964, the
24th Amendment finally
outlawed the most egregious
abuse of the denial to vote
by eliminating the poll tax.
I want to move on to
Georgia’s constitution, but
you can see why Murphy’s
decision was based, in part,
on a finding that the voter
ID, which initially required
the payment of a fee to
buy an ID, amounted to an
unconstitutional “tax” on
the right to vote.
In Georgia, the state con

the people. The General
Assembly shall provide by

electors.
However, the voter ID law
has added a further provi
sion, requiring that proof of
the right to vote include the
presentation of very specific
identification, namely, cer
tain types of picture identi
fication.
This law, bizarrely permits
the use of a picture ID from
a state college or university
(like Macon State College),
but not a private one (like
Mercer University).

tion, and stated, essentially,
that the state constitution
very specifically guaran
tees the right to vote to all
citizens, but only gave the
General Assembly the right
to legislate the “registra
tion” of electors; the state
constitution did not give it
the right to legislate proof
of the right to vote at the
polls.
What this means is that all
duly registered voters have
the absolute right to vote;
requiring them to have an
ID to prove the right to vote
at the polls is beyond the
right to control the registra
tion process.
Is this judicial activism?
Personally, I think not.
Simply stated, the General
Assembly has the right only
to control registration for an
election, but not the right
to limit the right to vote,
once registration has been
completed.

Why are we evaluating
oup organization's health?
Today’s article is writ
ten as if you, the
leader of your orga
nization, have invited an
independent consultant to
evaluate the strength of
your company’s results,
operations, relationships,
and culture.
You might use this article
as a script to explain to
the members of your orga
nization why you’ve cho
sen such an intervention,
enrolling them to cooperate
in responding to the consul
tant’s questions. If you are
considering a possible orga

you are closer to conducting
the evaluation, modify it to

“We will use the term
‘organization of excellence’
in a very specific way. I con
fess that I don’t yet under
stand the concept very well
myself. But rather than
learn about it alone, I want
us to learn about this next
level of organizational qual
ity together.
“So, I have decided to
invest some money in con
ducting an ‘organization
health assessment.’ Some
of you will be interviewed
to determine a snapshot of
our organization as it exists
right now. It’s similar to
going to your doctor for a
physical exam - you obtain
a report of your status as of
that particular day.

to have everyone in the

but that’s not practical. So,
I’ll be working with [name

“Please know that I want

“Well, that’s about all I

What are your questions?
I confess I may not know
