This muse came on to L? heard on the transcript of
tin* Record from the Superior Court, of the county of
Bibb, and was agreed by Counsel, W hereupon,it n*ron
sidered, and adjudged by the Court, that the Judgment
ofthe Court below he reversed on the following grounds:
First.—Beqanee it is the opinion of this <*onrt, that
the Rill holders had a paramount lien only on the F ind
raised by the aide of the Railroad from Macon to Griflin,
ana so much only of the Road from Griffin to the termi
nus, in DeKalb, as was built by the Monroe Rail Road
and Banking Company, prior to the 2d day of August,
1812. and that the Contractors of the second narf under
the agreement of the 2d August, 1842, in the Record
mentioned, had a prior and superior Fquily to the Bill
holders to he paid out of said fund, in proportion to the
relative value of the work done by them on said Road,
and materials furnished between Griffin and the termi
nus ofthe Rond, in the countv of DeKalb, nnd flint the
Court below committed error in excluding said Con
tractors from a participation in said fund to the extent
of the relatiee ea/uc qf their claim for work and labor
done, and rhateriulsandequipment* furnished said Road,
between the city of Griflin and the terminus of the Road
Jn DeKalb, ns aforesaid.
It is further the Judgment of this Court, tint the rel
ative value ol the work and labor done, and jnaterials
snd equipments ‘urnhhed on said Road, fiy fui Con
tractors, between the places last aforesaid, ie apportion
ed by three Commissioners to he appointed bv the Com t
below, with power to hear evidence in relation thereto,
nnd nmke report therein within such time us to the said
Court filial! deem expedient.
Second. —Because the Court below committed error
in deciding “That the Bank Bills should take each ia
proportion to lh<* value received by-the Bank for it nl the
time of its emission by tho Bank/’ \\ being tlee opin
ion of this Court, that each Bank Rill should take in
proportion to, the quantum of consideration paid there
for by the holder or claimant on the Fund, and that such
holder or claim'll)! should slate the quantum of consid
eration actually paid therefor, on oath, in writing, with

In obedience to the foregoing Judgment,decision,and
order of the Supreme Court ot the State oi‘ Georgia,
It is ordered by this Court, that John N. Williamson,
Esq. 1 us the county of Newton, W t>r, I). Alexander, Esq.,
of tlie county of Meriwether, and ( harles F. M. Garnett,
Esq., the Chief Engineer of the Western and Atlantic
Railroad, he, and they are hereby in virtue of the Judg
ment aforesaid, appointed Commissioners to apportion
in conformity to the raid Judgment, the relative value
of the work and labor done, and materials and equip
ments furnished on ti e Monroe Kuihoud between the
ci,ly of Gnthp and the lermiuus of said Road, iu ike
county of DcKnlh.
It is further ordered by this Court, that if the claims
of tl contractors for such work and labor done, and
materials and equipment# furnished, have been transfer*
red, the pre*ynt holders thereof shall state the quantum
ol consideration actuallv paid therefor on uaih, in writ
ing, with the right of other contesting claimants for the
fund set apart by the Judgment aforesaid, for the pay
ment of debts or claims of this character, to traverse |fi
same, which said oath ill writing shall bo delivered to
the Commissioner*afMfiaid. It is further ordered, that
the (a)imnis*i’ tier* aforesaid, do forthwith proceed to
thncityof Griffin, and then and there to adopt such
measures as shall enable them fully to carry into rffect
the Judgment aforesaid, and to repdrt their proceedings
to the presiding Judge ol this Court, on or before the
first Monday in January next.
It is further orjered by tips Court, in ohfidienre to the
aforesaid Judgment of the Honorable the Supreme Court,
that the holders or claimants on the fund set apart for
the payment of Bank Hills, shall, on or befoie the first
Monday in February next, file with the Clerk of this
Court, their oath in writing, staling therein the quantum
of consideration actually pnid by each of them fo r the
Bank Bill* so held or claimed, and thHt Robert V liar-*
deinan, Richard &. Hines, and Henry G. Rots, Ksqrs.,
make out aiul report to the Judge of this Court h full
nnd complete statement of what shall be the asa * ruined
proportion of each claimant.
2 1 is further ordered, that the Clerk of this Court forth’
with furnish to each of the said CounniHsKHiers, first *•
foraoaid, n true copy of the aforesaid Judgment of the
Honorable, the said SSupmua Couit, and also of tiu
order.
It is further ordered, that this order be published once
a week for eight weeks, in the Gazette# of MilledgeviMe
aud Matron.
And further, that in the event ofthe refusal of either
of the Commissioner# aforesaid, to accept, thut they are
