mating, alleging and propounding that on or about
the twenty first day or June, in tho present year, it
was agreed between the agents of tho ebip Portia

libellants, that the sold ship Pat (lament should pro
coed to Cardiff, and thence convey a cargo of rail
road Iron, not oxceedlug twelve hundred tons, to
FornandlUH, Amelia Inland, Florida; and deliver the
wune, oabeing j»»lu freight; that, at the time el
making sold agreement,It was represented by the
agents of sold ship, that with tho sold cargo she
would draw from eighteen to nineteen feet only;
that tt was fortber agreed, iron arrival off Amelia
Island, it shonld be ascertained, from the pilot, that
there was not sufficient water to admit tbo ship so
that she could get up to Feraandina, the Captain
should have the right, upon having the flut duly
certified by a licensed pilot, to proceed to Bi

that port, then to go to Savannah,or so near thereto
that the aald atrip arrived off Amelia Island on
on the bar, on thatday, tall twenty rest or water,
there was amply sufficient to admit theehlp: never
theless, the wind being adverse, the sold ship did
not attempt to enter; that, on the following day,
tbe wind having in the meantime continued to blow
from the west, and thereby greatly reduced the
water oo. the bar, tho master of the said ship ob
tained from the pilot In charge a certificate that tbe
told ship drawing nineteen end one hair tost ot
water, could not oroes the bar that morning, and
immediately and without torther delay, Bailed away
tor Bavonnah; that at Ihe Ume when the said shij

has so continued hitherto, and the anchorage per
fectly secure, and that it la tne custom tor snl|»
and vessels to wait a reasonable Ume tor fovorable
winds and tides to cross all bars, and this tbe more
especially at those ports where the old of siean
cannot be obtained; that there Is reason to believe
that the master or the sold ship exaggerated het
draught, and that tbe same did not oxceed nineteen
toot os represented by her agents st thu time oi
making the sold contract; but that, even with tbe
draught ofnlnotoenand one half feet, tbe sold ship
could have crossed the bar on diver* days elact
she so sailed away, and without hat log b en com

the inboequentproceedlngs of the said muter wore
merely a pretext to shield bis owners from legai
responsibility tor such violation; that the said mu

toFernandwa and deliver his said cargo, but Insists
on delivering tbe sam* at 8avannah on being paid
