B. F. Moore, being sworn, produced
in Court two psi>ers—one a consolidated
statement of the earning, aud expense*
of the rood for tiie fiscal year, ending
September 30, 1870; and tbe other paper
was u trial balance, both of which were
made out iu lead pencil figuring. This

9SI8.8flfroifi tbe \x»is, of rtrffjer, fails
to balance by that amount Tbe figures
were taken from tbe foot notes in pencil
from tbe books, and therefore tbe papers
were not acqrreet representation of the
liobKI. sphere waftro nstne signeVf to
them, nor were they addressed to any
one. Tho books were not settled np.
Saw nothing on these papers in the »l*|pe

petent book-keeper to make out a report
in pencil l>efore making a formal report
A* L. Harris, sworn, and testified that
the paper 1 landed him is the one McCal-
la gave him, after repeated solicitations
the report of the earnings and expen
ses of Western and Atlantio Hood, and
so stated it when he gave it to him. That
he told McCalla hb wanted the statement
for the purpose of Incorporating it in the
annual report. In the report was an
amount of $154,000 to tho credit of L P.
Harris, us Treasurer of the road. Neith
er oge could - explain how that was, us
everybody would know that I. P. Harris
did not loan the rood thut amount of
money. Witiiefes remarked to XcUalla
at the time that he did not like the looks
of that item. McCalla then told witness
lie could make a littlo “star" At that place,
and refer to it at the bottom in a note
explsiuiug that the $154,000 to Harris’
credit was for bills payable. Tho wit
ness did not make the note at the bottom
os McCalla suggested. Both he and Mc-
Colla concluded that the statement would
not look right.
J. O. Alexander was sworn, but before
he was examined |iiu attorney objected on
the grouud that Alexander was under a
bond for his appearance in court, as be
ing connected with this matter, and,
therefore, could not be forced to testify,
os being liuble to implicate himself. The
Court so decided. And farther, that ev
idence going to show that McCalla hod
made such propositions as the above,
were irrelevant, and the prosecution
could not go outside of tbe charge prefer
red in the warrant for his arrest.
When this decision was given, the pros
ecution withdrew the warrant, and the
case was dismissed.
