Mayor's Court. —A well-lm own citlssn was brought
Dtfore His Honor yesterday morning, charged with
driving under the trees on Bay street to the Point
near the Pilots’ Light. He stated that he was not
aware of any ordinance prohibiting the driving rm<*y
the trees, as it was customary prior to the r^Mta-
biiibment of civil government As the ordinance is
one of long steading, and known to almost every otti-
itn, he was fined f 5.
C. Roberts (colored), firing a musket in the city,
"•&* let off on payment of costs. Roberts stated that
he was going to leave the city, and desiring to take
hii musket along, went out by the hospital to lire the
ioad off, thinking he was outside the limits.
C. Holt, a colored woman, charged with striking and
abusing witness, a white woman, and threatening to
nhoot her, was fined $6; to be tent to jail in default of
payment.
KaTIO^al Express Company.—We were shown a
few days a nee a letter from Col. Woodward, the 8u-
yerint' ndent of the Southern Division of the National
txpress Company, containing a list of the large num*
ber of cilices which have been established by him in
thi* State, and giving a glowing account of the busi*
ness prospects of the company in the different cities
sad at stations on the different roads where way
offices have been established. The business prospects
of the Company, we are informed, are flourishing, so
much so that in several cities where offices have been
recently opened, additional warehouses had to be pro-
cured to accommodate the large amount of freight re
ceived for shipment. Since Col. Woodward became
associated with tho Company new energy seems to
have characterized the efforts of the various business
departments ; offices hare been established in Savan
nah, Augusta, Atlanta, Macon, Columbus, and all in
termediate points, and direct communication will soon
made to all the interior oities and towns, and
through to Mobili snd New Orleans. The tariff of
rets? Is based upon a fair business per centage above
sosi. of transportation, and with the presenbreliabillty,
promptness and dispatch of the company sustained,
6i,d with such officers as (*en. Joseph E. Johnston,
CoL Woodward and Maj. Jickling, it cannot fail to
succeed.
Fire.—A fire broke out about half past nine o'clock
yMterday morning amonget a quantity of cotton ly
ing ai the Florida Steam Packet Company’s Wharf.
The cotton is supposed to have caught fire from the
spare of a pipe or segar. There were two hundred
end fourteen bales of cottton on the wharf, between
nnsty p.ud a hundred bales of which was burnt. A
§rau porrion of the burnt cotton will however be
•Aved, bur in a damaged condition. A pile of light
»xd containing about twenty cords lying close by,
also took fire, the greater portion of which has burnt
Bp. We learn that the cotton, which arived from
Augusta by the steamer Eclipse, on her last trip, con-
ig^edto Octavus Cohen, was fully insured in a
Sonhern offic-. The fire companies were promptly'
on the ground, and succeeded, after great exertions,
il subduing the flames, as well as keeping the cotton
(djacent to that which was burning, from taking fire.
The caM of S. M, Varnadoe ts*. T. A Goodwin and
Wallace H. Milieu, waa tried before the Superior Court
yesterday.
The case occupied the attention of the court the en
tire day. It appears that Meean. Millen & Goodwin
♦ere the owners of the salt works located at Coffee
Bluff. On the 10th of October, 1864, Milieu sold his
interest to Goodwin, consisting of mules, harness,
tanks, boilers, and all appurtenances attaohed to the
salt works, for which Goodwin paid Milieu $7,000 in
cash and gave two notes of $7,900 each, payable re
spectively in thirty and sixty days after date, at the
Farmero’ and Mechanics’ Bank. The notes were
placed in bank for collection. The first note waa dis
counted, and when due, Mr. Williams, tba book
keeper of Mr. Goodwin, went with Millen to tho bank,
and told the cashier that Mr. Goodwin was abaert
from the city, ana that he did not nave the money at
that time to take up the note, but hoped to be enabled
to do so in a few days. Several days after Millen took
both notes out of bank, and in the month oi March,
1865, endorsed them over to Samuel M. Varnadoe, in
part payment of the purchase money for a plantation
in Jonesviile, Liberty county, sold by Varnadoe to
him. An action was brought by Varnadoe against
Goodwin as maker, and Muien as endorser of two pro
missory notes fbr $7,000. Goodwin plead that the
note's were payable at theb ank and that he had gone
there to pay them, but found that Millen had carried
them away from the city. He also plead ths ordinance
of the Convention setting forth that it waa a Confed.
erate debt, and that ths notes having been endorsed
to Varnadoe by Millen after they were due, that the
same equity existed between Varnadoe and himself as
between Millen and himself. Millen plead the ordi
nance of the Convention in regard to Confedersts
debts, the notes having been given by him as part
payment for the plantation. All partlea were ably
represented; Varnadoe by Mbssts. Hartridge k Chis
holm ; Goodwin by Messrs. Harden k Levy, and MiUen
by lion. Thos. E. Lloyd.
Judge Fleming, in charging the jury, stated that a
tender in gold or any other legal tender only stops in
terest and charges, and that the tender of a note pay
able at bank must be made by depositing the money
in bank; the notes being indorsed after due, that she
original equity which existed between Millen and
Goodwin existed between Varnadoe and Goodwin;
that Varnadoo could only receive from Goodwin the
amount which Millen could recover from Goodwin in

dinance of the convention, Milleh would b« entitled to
recover from Goodwin the valU9 ot the article that
Goodwin bought or received from Millen, and for
which he gave Millen his notes, and that Varnadoe
•ould recover from Millen ths value of whpt he sold
MiUen for these notes so Indorsed him. The case
was very complicated and U1 suited to a petit Jury,
who retired to their room about a quarter before eight
o’clock. In about a half hour they returned, with a
verdict of $6060 for Varnadoe; but as the verdict did
not embrace the two cases, they again retired to the
Jury-room, and returned about a quarter past nine,
bringing in a verdict of $6,000 for plaintiff, S. M. Var
nadoe, being the fuU value of the property in Liberty
county, and $9,030 for Millen against Goodwin.

Meeting of tbe Board ef Health.
The regular meeting of the Board of Health wea
hold last evening, tbe President, Dr. John D. Fish, in
the Chair.
The City Marshal stated that tho nuisances reported
at the last meeting had been abated, or were in pro
cess of abatement. Tbe reports of the several Ward
Committees showed a marked improvement in the
sanitary condition of the city, comparatively few new
nulsanoes being complained of.
Tbe committee to which was referred the matter of
the *J. S. slaughter pen reported that that dangerous
nuisance was to be removed by the military authori
ties outside the city limits as soon as a new slaughter
house oould b« built.
A communication was received from ths Medical
Society, enclosing a report from a committee of that
society upon the drainage of the low lands surround
ing the city. The report was of great length,’ embra
cing a thorough investigation of the subjeot. It states
that tbe lands east of the city can be drained only
with great difficulty, and at a considerable outlay, the
canal being nearly filled and tbe ditches Intersecting
the lands having become mere farrows. The whole
tract lea repoelso :y for the filth end refuse of the city.
Throughout the low lands in the Western environs of
she city there were also numerous deposits of filth
which were constantly being added to.
The report dwells at considerable length upon the
drainage of the Springfield Plantation. The Commit
tee believe that this could be accomplished by com
pleting tbe canal running from tha beck districts of
the plantation to the river, which was begun some
years ego by tbe city, and repairing tbe drains
communicating with It. The ditches end drains
throughout the tract are in an extremely bad condi
tion, being nearly choked up with weeds and debris,
and some two hundred or more acres of the back lands
are covered with water to the depth of several inchoe,
thus presenting the most favorable condition poaaible
for the production of -aiasma. Although tbe Com
mittee consider it a matter of imperative necessity
that these lands should be drained at' once, they ad
vise strongly agaiustits being undertaken at tliia late
day, owing to the danger attending tbe turning up of
the earth in tho low glands during the summer
months.
Dr. Waring, from the Committee on the low lands
east of the city, back of Lamar's flour mill, reported
t hat owing to the dilapidated and ucglected state of j
the dams and ditches on these lands thay overflowed
at every high tide. The Commute* stated that a ques
tion had arisen between themselves and Mr. Lamar as
to his liability to repair tbs’ dams and drains, but they
urged that the work be executed at once by tha Board,
whether at the expense of the city or of Mr Lamar
io be afterwards determined
Mr. Stewart stated that tbe attention of Council had
already been directed to those lands by tha report of
the Inspector of Dry Culture.
The report of the Committee Whs then referred to
the CounclL with the recommendation that ths work
of rebuilding the dams and cleaning qut the ditches
and canal be attended to at once-
The meeting then adjourned.
From Philadelphia.—Tba screw steamship Pio
neer, Capt Gallagher, arrived hers last evening from
Philadelphia, in seventy hours, having loft that city
on Saturday morning last. Wo understand, that this
ship, which is a superior one, and has fine accommo
dations for passengers, is intended to be placed regu
larly on tbe line by the Southern Steamshiji Company.
Her captain is a thorough-going seaman, and we are
glad that the company has secured the services
of our friend, Mr. C. G. Harding, late Purser of the ,
steamship Cumbria, in the same capacity on this ship.

The Recent Infanticide Case.—The case of Nora
Cope, alias Jackson, colored, has been undergoing in
vestigation before Justices Phillip M. Bussell and.
Laurence Connell. They have decided that there was
no evidence against Nora which would go to show that
she committed the crime with which she is charged,
but they were of the opinion that there is sufficient
evidence to warrant her being tamed over to the Su
perior Court for attempting to conceal the death of her
child, which Is a punishable offence, according to the
Code of Georgia.
Sociable.—The Young Men’s Social Club, of this
city, composed mostly of Germans, and recently or
ganised, with Mr. Geo. Laurence, as President, gave
the first of a series of social hops at the Volks Garten,
on Monday evening last, which was well attended
and was In every respect a great success. About one
hundred and fifty gentlemen and ladies amused them
selves in keeping time to the excellent music of Mr.
Buckert’e cotillion band, led by Mr. Mayer, nntil long
pas^midfiight.
AT Quarantine .—The Captain of the schooner D. C
Houghton, from Philadelphia, in coming in over this
bar on yesterday, informed tbe pilot who went to
board him that be bad sickness on board, whereupon
the pilot took a sell boat and kept ahead of the vessel
nntil she got in the old quarantine Eground near
Tybee where she was. anchored. Tbe sickness con
sists in a case or so of small pox. '
Schooner Luella.—We learn from Capt. Colas-
bury, of tbe Ur S. steamer Nmnsemond, that tbe
schooner Luella, which went ashore on the south
side of Mosquito Inlet about a month eineo, is now
high and dry upon the beach with only «lx Inches of
water around her at spring tide, having been washed
up by tbe ees. Tbe veeael'ls all complete end every
thing standing the tame as when she went ashore.
