A Serious Omission in the
New Constitution.
Since tlio undoubted ratification at
t he polls of the late work of the Con
volition, a legal friend has called at
tention to the fact that the new Con
stitution goes immediately into effect
as soon as the Governor proclaims its
adoption.
That instrument, however, makes
no provision for the holding over of
t he.old Legislature and homestead,
until the recently elected General
Assembly have been qualified and
taken their seats. It declares very
distinctly that the functions and
powers of the old body cease with
the election of the new.
Ilencc, if our excellent Governor
(who heaven preserve) should suc
cumb to disease, or fall under the
band of an assassin witliiu the next
eleven months, Georgia would be
without a government and practically
in a state of anarchy.
The code, article*41, section 1,801,
declares, “ whenever the office of
Governor shall become vacant from
any cause, it shall be ri-e duly of the
lVesideut of the Senate, ami in the
event ot the death, resignation or dis
ability ot the President of the Senate,
then the Speaker of the House of
Representatives, within thirty days
alter the office of Governor has be
come vacant, to order a special elec
tion to be bold throughout tho State
fin* Governor to fill such vacancy
which said election shall be directed
to. be held within sixty days a ter
said vacancy ”
But in this instance there would
be no President of the Senate or
Speaker of the House of Representa
tives to step into his shoes and keep
in motion the machinery of the gov
ernment. An examination of tl e
new Constitution makes, this at .> ;<v*
apparent.
What then can be done? Wh- su^.
gest, whilst open to eonvic ion if a
belter plan can be proposed, that
Governor Colquitt be asked to call
an extra session of the Legislature
for the specific purposes of organiza
tion, the appointment of suitable
committees to look into and expedite
the work of the next regular session,
and to make an appropriation that
may be deemed nec*ssary for the
coming year, or changes in the tax as
sessment.
Under the new Constitution the
duties ot tile called se.-sion would he
limited to the specific matters named
by the Executive, and general legis
lation would be prohibited.
W e can conceive of no other met hod
of bridging the hiatus wli’ch must
ensue between the present moment
and the assembling of the Legisla
ture next November. Still, what we
write is merely in the form of a sug
gestion.
ANOTHER VIEW OF THE CASE.
Since writing. the above, another
member of the bar has handed in the
following:
Paragraph 6th of article S o’ the
new Constitution declares as fol
lows :
The officers of the government
now existing shall continue in the ex
ercise of their several functions until
t heir successors are duly elected, or
appointed and qualified ; but nothing
herein is to apply to any officer whose
office may be abolished by ibis Con
stitution ”
Does not this clause provide for
most of the difficulties anticipated in
