AN ACT
To establish a tribunal to enquire into the qual*
locations of persons claiming to practice Me
dicine, Surgery, and Midwifery, within the
city of8avannah, and to grant certificates to
the same, if found properly quslified.
Whereas, it appeari by a memorial of the
Mayor and Aldermen of the city of Savannah,
that the good people of said city, and especially
the poor and illiterate people thereof, have suf*
fered heretofore much evil from the want of
proper laws to regulate the practice of medi
cine, surgerv, and midwifery therein, the con
sequence of which want haa been the indiscri
minate and arrogant pretentions and undertake
tugs of many unlearned and empirical persons
to practice therein in the said arts: And where
as, sound policy and a proper regard for the
healths and lives of the citizens of a commercial
S populous, and growing city, require that the lc-
stature should guard against such an evil for
e future:
§1- Be it therefore enacted, by the Senate
and House of Representatives of the state of
Georgia, in general assembly met, and it is
hereby enacted by the authority of the tame,
That the Georgia Medical Society, established
in the city of Savannah, shall be invested will),
and possessed with full power and authority to
examine, enquire into, investigate, and deter,
mine on the professional qualification*, attain
ments and capacities of all and every person or
persons cliiming to practice within the limit! of
the said city in the said arts of medicine, surgery
and midwifery, or in any two or one of them,
and to grant certificates of qualification under
the common seal of the said society, or, if there
be no common seal, under the signs manual of
their president and aecretiry, to him, her, or
them so claiming and making application there
for, if by a majority of said society, he, she, or
they shall be deemed duly learned and qualifi
ed. And it shall be the duty of the members of
the said society, when application shall be made
by any person or peiBons, for his, her or their
examination to the end aforesaid, to convene at
their customary place of meeting, and to decide
upon the applicant’s petition, within ten days
atterthey shall have been summoned lo convene
by their president,*or in his absence, sickness,
or other inability, by the person or persons dis
charging his duties, or if there be not any such
person or persons, after they shall have been
summoned by their secretary. And it shall be
the duty of the said president, person or per*
sons performing his duties, or secretary, to sum
mon each and every member of the said society,
by a written citation, expressing the object of
the meeting, the name or names of the appli
cant or applicants, and the day of the examint
tion, within ten days after the application shall
have been made to him or them : Provided at-
wage, that prior to the examination ot any and
every applicant, the members of the said socie
ty shall severally take a solemn oath, to be ad
ministered by the mayor or any alderman of the
city of Savannah, well, truly and impartially to
exumine and decide upon the attainments and
qualifications of the applicant or applicants, and
to grant certificates of qualification to him, her
or them, if in their judgments, he, she, or they
shall be found duly learned and, qualified to
piacticein the said arts of surgery, medicine,
and midwifery, or in any two or one of them
And provided also, that In their examination,
the said society shall be restricted and confined
to the investigation of professional attainments
and capacity alone, without regard to any for
mer or present professional or morul reputation,
and shall not at any time require as a test ol
qualification, or any degree of evidence thereof,
mat any applicant should have obtained a diplo
ma from any medical college or university, or
should have studied thereat, or elsewhere.
4 2. And he it further enacted, by the author
ity aforesaid, Thut if, after application shall
have bem made, agreeably to the provisions of
this act, the president of said society, or other
person or persona performing his duties, or
there being no such person or persons, if the
secretary of said society shall refuse, or shall
delay till after the time heretofore prescribed
to issue summonses for convening the members,
or if he or'they shall appoint a day for their
convening more remote than the tenth day from
the day of the date of the citation, the person
or persons applying mav severally institute an
action or suit at law in the superior or inferior
courts of the county of Chatham, against the
said president, or person or persons pei forming
his duties, or against the secretary, to recover
damages against him or them, in his or their in
dividual capacities, for his or their refusal or de
lay, or improper appointment. And if after be
ing summoned to convene, the said society shall
fail to do so on the day appointed in the cits
tion, or afterwards on an adjourned day, but i
day within the time heretofore prescribed for
their convening, or if, having convened, they
shall severally fail to take the oath aforesaid, or
having taken such oath, shall fail to proceed to
the examination aforesaid, and to a decision
thereupon, or if the said society shall in any re
spect violate the provisions of this act, it shall
be the duty of the judge of the superior court
of the county of Chilham, upon the petition of
the party injured, setting forth any such failure
or violation, and supported by his affidavit of
the truth of such petition, to grant, aa r
matter of right, a writ of scire facia*, direct
ed to the president and members of the said
society, requiring the said society to shew
cause at the next term of the said court,
why their charter or act of incorporation shoult
not be deemed forfeited. A copy of this writ
and of the petition shall be served upon the
president or secretary, and if the allegations be
denied, an issue shall be joined, and the facts
be triedby a jury empannelled and sworn as in
other cases. If the allegations of the petition
be found to be true, or if they be admitted, and
no good cause be shewn, it shall be the duty of
the court to adjudge the charter forfeited, and
to order execution to issue for costs against any
property of the said society. If no appearance
be filed on the first day of the term, or if having
appeared, good cause be shewn for the former
failure of violation, it shall be the duty of the
court, upon application of the party injured, to
appoint a day not more> emote than ten d.q m,uii
which the aociety shall convene, and conform
m every thing to the requirements of this act,
and to the order for this purpose no return shall
be received from said society but one of abso
lute compliance under oath of the president or
secretaryj which return shall be filed in the
clerk's office within five days after the appoint
ed days- On failure to make such return, the
judge of said court shall, in vacation, award a
judgment of forfeiture of the charter, upon ap*
plication as af oresaid, and execution shall issue
for costs aforesaid.
4 3. And be it further enacted, by the author
ity aforesaid, T hat if any person shall be refus
ed a certificate, he or she may again apply for
examination after a lapse of six months, and it
shall be the duty of the said society to receive
any number of applications, and to conform ou
each application to the provisions of this act, and
subject to all Id ittponsiUHtlM, provide

4 4. And be It further enacted, by the
Ity aforesaid, That If any person olslmlng to

of ilium, In the said city, shall presume to do so,
openly or covertly, not having obtained a cer
tificate of qualificatinn, it shall not he lawful
for such person to recover in any court of law
or equity in this state, his or her fees or charge•
for services done within the said city of Savan
nah i nor shall it be lawful for any company or
copartnership of oncertlfloated persons} and
such person shall he moreover liable to prose
cution by indictment in the court of common
picas and oyer and terminer of said city, at the
instance of the mayor and alderman of the said
city, or of any common informer. Bonds of pro
secution shall bo given as in other cases arising
under the penal laws of tins state; if at the in-
stance of the mayor and aldermen, the bond
•hall be given by some person acting under
their sanction or authority, otherwise by the
common informers and upon the first convic
tion, the accused may be fined by the court in
a sum not exceeding one hundred dollars, and
on each subsequent conviction, in a sum not ex
ceeding t ( wo hundred dollars, beside* costs of
prosecution in each case j one half oftltc fine*
shall be paid Into the treasury of the city of Sa
vannah', or to the common Informer, and the
other half shall be equally divided between the
Union Society and the Female Asylum Society,
for the benefit of the orphans and children ol
said societies.
4 3. And be it further enacted by the Au
thority aforesaid, That no part of this act shall
be so construed as to affect any person or per
sons now practicing, or claiming to practice in
the said city, in the said arts, or in any two or
one of idem, and now residing in the said city,
or who shall b« engaged in the practice of the
same, or of any two or one of them therein, on
or before the first day of February next.
4 6. And bo it further enacted by the author
ity aforesaid, That if the Georgia Medical So
ciety shall communicate to the executive de
triment of this state, on or before the said
irot day of Februaty next, their acceptance of
this act as an act additional to their charter,
and that they are willing to be bound by it*
conditions and requirements, this net shall ii om
thenceforth commence in full and complete
operation, but otherwise shall be totally null
and void: And be it also enacted, that the said
society ahall, before the saM first day of Febru-
ary, give notice of their said acceptance to the
mayor and aldermen of tire said city of Savan
nah, whose duty it shill be to make said accep
tance public by advertisement in all the public
gazettes of the said city, three times • week,
tor the space of one calendar month.
4 7. And be it further enacted by the author
ity aforesaid. That in the event of the accep
tance by the said society of this set, agreeably
to the aforesaid section, this act shall continue
until the first day of January, one thousand
eight hundred and twenty-six, and no longer.
