In restraint of trade, it waa held
also to be monopolising interstate
commerce in violation of the Sher
man anti-trust law. The dissolu
tion of the combination waa ordered
to take place within the next six
months.
Thus ended the tremendous strut;
gle of years on the part of the gov
ernment to put down by authority
of law a combination which da claim
ed waa a menace to the Industrial
advancement of the entire country.
"Undue" Iteatrains.
At the same time tbo court In
terpreted the Sbermffn anti-trust law
so aa to limit Its applications to acts
of "undue" restraint of trade and
not "every restrain of trade."
was on thils point that the only atm-
sordant note was heard in the court.
Justice Harlara dissented, claiming
once for all that the words “undue'
or ‘‘unreasonable" or similar words
were not In the statute. He declared
that the reasoning of the court In
arriving at its findings was In effect
legislation which belonged in every
instance to Congress and not to the
court.
Kver since the decreo In this case
In the lower court, the United States
Circuit Court for the Eastern Dis

Tonight that soctlon of the opin
ion calling for the use of the "rule
of reason” in applying the law la

answer to the prayers of the "bual-
neva world.”
The opinion of the court was an-
nounntd by Chut Justice Whits. Ill

>0,000 words. For nearly an hour
the chief justice discussed the ease
from tho bench, going over most of
the points In the printed audience
of the moat famous men of the
country, Senators and representa
tives left their respective chamber!
in the Capitol to listen to the epoch-
making deolalon of the court. Moat
eager hearers were Attorney Gen

ernment, who had conducted the
great fight against tho Standard Oil.

The fight is going to be based on
tho argument that the present law
has proven unsatisfactory and un
fair to everybody. It has neither
fish nor fowl, pretending to close
saloon# and ye* leaving them open
for the breweries.
It is claimed that tho local op-
tlonists can already see a majority
In both the house and senate, and
that the present prohibition law is
almost bound to go.
It 1« said that the agitation of the
Oeorgia Anti-Saloon League, striving
to closo up locker clubs and en
force the law more strictly than
ever In certain local cltlee, has had
a good deal to do with precipitating
the fight, though the local option
people declare they are going to
make It anyway.
It Is believed that by the opening
of the legislature, the brewery and
the whiskey Interests which have
Bomewhat been divided since the
present law became effective, will be
lined tip together again, and that’
with them' will he many former
honest prohibitionists, who have be
come utterly dissatisfied with the
working^ of the present statute.
