CANDLER DECIDES MONEY CAN BE

ciding whether the public proper
ty fund can be need for paying
interest on the public deb*.

A dispatch from Atlanta says:
“Judge John 8 Candler decides
that tbe Howell resolution appro
priating\$326,880 from the public
lie property fund to the payment
of interest on the public debt
was entirely constitutional and is
sued an order as a result of the
mandamus proceeding directing
Treasurer Park to use the money.
“Treasurer Park is not satisfied
with tbe decision of Judge Cand
ler, and through bis attorneys,
Logan B. B eckley and Orville A,
Park, will this afternoon file a
-bill of exceptions in the supreme
court,-which will bear arguments
Friday morning. There is much
interest here iu tbe cane, as the
state’s financial condition will be
much embarrassed if tbe decision
of the supreme court reverses that
of Judge Candler.”
Tbe case will be rushed through
tbe supreme court, as the interest
falledue-oD tbe first of .Jan nary.
Opinions differ about tbe legality
of tbe bill as passed. Tbe etate

strained just a bit, to meet the
emergency.
