nor rendered his decision In the appll-
cation tar a. writ of mandamus to com
pel tile trolley companies to operate
toelr lines today. From the Judge's ex
pression* In his decision on Thursday,
In setting the time for a hearing ns
to the kind of writ to Issue toe con
clusion was that the writ would be a
peremptory one. Thla would compel the
officers of the roads to operate all lines
at once or be In oonUmpt of court.
The Judge heard argument yesterday
and today Issued an alternative writ
of mandamue. This af.owa the officers
of the Urns twenty days to anwer,
and. the questions of fact as to whether
they have exercised their best endeav
ors to operate their lines may be tried
before a Judge or before a Jury.
The opinion of Judge Gaynor is as
flollowa:
My views of this case remain sub
stantially the same os they were at

first hearing. This corporation Is pri
marily » public one, and its flint duty
Is to the public. Its 'private duty to Its
stockholders cannot lawfully stand be
tween Its duty to the public. It Is en
titled. to the full protection of the
government in the performance of its
duties, protection on the one side and
obedience to law and duty, bring re
ciprocal and going bond In hand. It
h$s had such protection, and Itaow has
It. I do not find that the government
has failed in that respect at all. In
stances of disorders have occurred, but-
they have been speedily suppressed. I
cannot, therefore, attribute to the gov
ernment the failure of this corporation
to perform Its public duties and deny
this application. It followw that a writ
of mandamus must Issue. This court
upon this application stands between
the public and this corporation, and
may not swerve from a full declara
tion of the law and of the case, or
from a full compliance with it That
this corporation Is not fultDiing its or
dinary corporate duties to tho public
