from me” is absolutely and mnliolonsly
false. Yon have never mentioned tho

and onoe in the early part of this year.

Albany lodgo No. 718, B. P. O. Elks,
throngh a committee appointed for that
purpose, today oloeed a deal by wliieh It
aaqaired one of the mostvalnablo pieces
of real estate in the city.
The lot 'to 60x09 feet end faces Pine
street, between Washington and Jack-
son. It is tho lot on whioh W. H. Mil
ler's marble yard Is now located, and
the frontage to sixty feet. The property
was purchased from Hobbs & Davis,
and the prloe paid was not made publio.
It is understood, however, that the fig
ures represent a sum whioh Is considered
very reasonable. Tho E'.kB pay cash for
the property.
It 1a proposed by tho lodge to eroot, in
the near fntnre, one of tho handsomest
buildings In Albauy on its newly ao-
quired property. The building will be
of brlok, three stories high, aud oovering
the entire lot. The lower floor will be
fitted np for offices, while the Elks will
have their olnb and reception rooms on
the seoond floor. The third story will
be given np to the lodge room.

Atlanta, Deo IS.—The question of the
availability of tip publlo property fund
lor the purpose of paying the Interest
on the bonded Indebtedness of tbe state
will be submitted to the supreme court
at the earliest day possible so as to settle
the issue with as little delay as to neces
sary to oarry out tho law.
This afternoon an understanding was
readied between Governor Candler,
Btate Treasurer Park and Attorney
General Joseph M. Ten ell by which the
Issue will be presented to the supreme
oourt at onoe. The attorney-general
says that he thlnke that tho oase oan be
srgned in the-supreme court Thursday
or Friday of next week. The governor
will reoelve'the resolution tomorrow
and will sign it as soon as it reaohes
him. Under the provision, of tbe reso
lution the treasurer is required within
twenty-four hours after the signing of
the measure to make u transfer of tho
publlo property fund to the Interest
nooouat. This he will reluse to do,
and then he will be served witb a man
damus requiring him to show cause
why he has not carried out the law as
set forth In the resolution. The oase
WjU first go to some superior court
judge and then on to the supremo oourt.
It is more than probable thne Judge
John S. Candler will be the jundge who
will hear the mandamus, and an ar
rangement has, or will be perfeoted by
which Judge Candler will consider the
oase Monday next, and deoide tbe ques
tion as soon as he has heard arguments
on both sides of the issue.
The governor will be represented by
Attorney General Terrell and the treas
urer by Judge Logan E. Bleokley, of
Atlanta, and Mr. Orville A. Park, of
Maoon.
Under the law the. attorneys of tho
treasurer wonld be entitled to ten days
to propare their answer to the suit, bnt
as the issne is a friendly one in every
respect it is hardly probable that this
point will be raiBod.
The state will pay tho expenses of tho
suit, whioh, it is Baid, will be nominal.
It is understood that the attorneys on
both s'do« of the case will be ready to
prooeed os Boon as the time limit al
lowed the state treasurer to make tho
transfer of the money expires.

this morning, that the firm had gone
into voluntary bankruptcy, and that the
assets would be found to greatly exceed
liabilities. The business oould lmve
been oarried on for some time longer,
but it was thought best to pnt its affairs
in bankruptcy anjl save embarrassment
threatened by obligations soon to ma
ture. The firm hopes soon to be able to
arrango its affairs satisfactorily and re
sume operations.

turned from the North, where he has
been several days on business for his:

cook signed an order for twenty miles of

bany. The first ship load left Philadel
phia this week and is expeoted to arrlvo
here in a few days. Work Is lo begin at
onoe on the extension and will be pushed
to completion. Mr Pidcook told the
Observer that he expeoted to be in Al
bany by Maroh. He will give personal
dtreotlon to the work and wil, be as
sisted by hls brother, Mr. J. N. Pidcook,
who will come down in a few days. A

work. Tho road haB recently purohused
two big engines, one lias arrived and
the other will bo delivered in a fow
days. Three new passenger coaches are
being made or have been made. As

Little Clyde Gall, the four year old
daughter of Mr. aud Mrs. F. E. Cull,
has a very sore mouth us the rosult of
eating some potash Saturday afternoon.
The little child was eating some candy
and pioked np a niece of potash whioh
happened to ho lying on tho ilcor.
Thinking it was a piece of caudy, sho
pnt it in her mouth aud has suffered
greatly from the burns it oaffBed.
As soon as the ohild's soreams at
tracted Its mother and she was told what
happened, a physician was summoned

layed to a great extent the palnfnl
burns.
Littlo Clyde is muoh better today and
her parents are congratulating them
