as Chief Justice. The New \ork 'limes
of the 11th inst. strongly protests against
it, declaring that it would be “an get
fraught with peril to the republic that
it is destined to ruin the Republican par
ly and revive all tho controversies of the
rebellion," «fco. Tho llerald of the name
day Hays that tho nomination is not satis
factory to Republican politicians; that
Cush ng “will be tried by the Senate upon
the test of loyalty to the Republican
party and its Southern Reconstruction
measures.
Tho import of these declarations is that
the Republican party wants a partisan
Chief Justice rather than a sound jurist,
und is not satisfied that Cushing is blind
ly committed to the upholding of ail that
has boon done by luilitaiy power. The
very quuliiy that ought to commend the
nouiipaiioii to general approval—freedom
from party bias and the absence of know n
obstinate prejudices—is what inakoa Mr.
Cushing objectionable to bis opponents,
iiis confirmation or rejection, therefore,
involves something more important than
personal considerations. It tests tho
question whether the supremacy of tho
constitution, expounded by a free aud
^mpuitial tribunal, is to be re-assorted
mid restored, or whether tho unrestrained
rule of blind partisanship is to bo con
tinued. We still indulge strong hopes of
Mr. Cushing's confirmation ; but outgiv
ings such us tho above awaken our ap
prehensions.

Lieut. Governor Robert E. Withers,
who has been nominated by the Domu-
crutio caucus as U. 8. Senator from Vir
ginia, aud to which position ho has been
elected, was born in Campbell county, in
that State, in 1821. He graduated at tho
University of Virginia, aud for nineteen
yours practiced medicine. He command
ed tho Eighteenth Virginia regiment in
the war. At tho l>uttlo of Games’ Mill
he was terribly wounded, and has not re
covered fully from the effects. Ho tried,
but could nut afterwards outer active ser
vice on account of injuries received. Af
ter tho war, bo was first editor of the
Lynchburg Nett* % and afterwards of tho
Richmond fa'tujtiirer. lie was an orna
ment to his profession, in 1808, he was
nominated for Governor niul canvassed
