wherein the City of Perry
is asking to be allowed to reinter the
remains that have been
washed up by floodwaters to higher
ground in Evergreen Cemetery
and erect a common memorial to the
memory of those remains, to
be allowed to disinter the remains
located in those graves that
have been uncovered and reinter said
remains to higher ground
in Evergreen Cemetery and to be
relieved from any and ail
liability, now or in the future, relative to
the damage to the
graves that were disinterred, relative to
the disinterment of
those graves that were uncovered and
relative to the reinterment
of all of the remains to higher ground in
Evergreen Cemetery.
You are further notified that by reason
of an Order for Service
by Publication entered by the Court on
Augu st 2,1994, you arehereby commanded
and required to file with the Clerk of said
Court and serve upon the City of Perry’s
attorney, David G. Walker, whose address
is P. O. Box 1234, 909 Ball Street, Perry,
Georgia, a response to said petition within

Sale contained in a Security Deed given by
Robert B. Tillery and Donna P. Tillery to
Collateral Investment Company, dated
October 26,1978, recorded in Deed Book
538, Page 350, Houston County, Georgia
Records, as last transferred to AmSouth
Mortgage Company, Inc. by assignment
dated December 31, 1986, recorded in
Deed Book 752, Page 369, Houston
County, Georgia Records, conveying the
after-described property to secure a Note
in the original pnncipal amount of THIRTY
TWO THOUSAND SEVEN HUNDRED &
NO/100 DOLLARS ($32,700.00), with
interest thereon as set forth therein, there
will be sold at public outcry to the highest
bidderforcash before the courthouse door

The above-described property is
conveyed subject to Restrictive Covenants
as contained in instalment of record in
Deed Book 190, Pages 92-96, Clerk's
Office. H-uston Superior Court; also,
subject to an easement for drainage
purposes over, upon and across the
westerly ten (10) feet of said property as
shewn on the aforesaid recorded plat of
survey.

pump, and garbage disposal.
The debt secured by said Security Deed
has been and is hereby declared due
because of, among other possible events
of default, failure to pay the indebtedness
as and when due and in the manner
provided in the Note and Security Deed.

provided in the Security Deed and by law,
