Criminal sentences given in Superior Court

The Barrow County Superior Court recently
sentenced the following people. Those charged
and their sentences are listed below. Charges
listed as nolle prosequi are those in which the
prosecutor or plaintiff indicated they would not
proceed with the case. In criminal cases, a dis
position of nolle prosequi may be entered when
evidence proves innocence or charges cannot
otherwise be proved.
The following sentences were issued as part
of negotiated plea agreements on Sept. 6, 2011,
with Superior Court Judge David Motes presid
ing:
•Marcelino Dominguez, theft by receiving
stolen property, open container violation; 10
months probation and an $800 fine. Nolle
prosequi: carrying a concealed weapon.
•Hans Jurgen Baroni, identity fraud, six counts
first degree forgery, giving false information to
a law enforcement officer, two counts driv
ing while license suspended, failure to exhibit
license on demand, affixing a license plate
with intent to conceal, no insurance, operating
a vehicle without a valid driver’s license; three
years incarceration and a $100 fine.
•Cheryl Denise Robinson, deposit account
fraud; 12 months probation, restitution of
Barrow County Sheriff’s deputies were sum
moned to report a case of criminal damage
to property at Apalachee High School earlier
this month after a student called 911 to report
someone had vandalized his vehicle.
The student told deputies he parked his 2005
Ford Explorer Sport Trac in the softball field
parking lot and left it for a little more than six
hours.
When he returned, both tires were flat and
obscenities were scratched onto the hood of
his vehicle.
The student said the damage was more than
$500.
Other recent incidents reported by BCSO
deputies included:
•civil matter at a Vinemont Way, Auburn,
residence. A White Plains, NY, woman said
she rented the house to a couple about six
months ago and has not had any problems
with them. The woman said she became suspi
cious when she did not receive rent in July.
$2,138 and a $250 fine. Nolle prosequi: four
counts deposit account fraud.
•Cheryl Denise Robinson, deposit account
fraud; 12 months probation, restitution of $460
and a $250 fine.
•Scotteva Toronto Burnett, possession of mar
ijuana with intent to distribute; 10 years proba
tion, credit for time served since April 15, 2011
and a $1,000 fine. Nolle prosequi: possession of
marijuana less than one ounce.
•David Lee Smith Jr., possession of
Dihydrocodeine, possession of Clonazepam,
possession of propoxyphene; five years proba
tion, no contact with victim! s) and a $3,000
fine. Nolle prosequi: possession of dangerous
drugs, drugs in original container, seat belt
violation.
•Ronald Nicholson, habitual violator, fleeing
and attempting to elude, weaving over roadway;
six months incarceration, four years, six months
probation, no drinking alcohol, no driving, ran
dom screening and a $2,000 fine.
•Austin Bishop Trimble, possession of meth-
amphetamine, harassing phone calls, criminal
trespass; three years incarceration, seven years
probation, no contact with victim! s) and a
$1,500 fine.
She attempted to contact the tenants by calling
and texting them, but received no answer or
response. She said she decided to drive down
from New York to see what was going on and
found the property abandoned. There was no
furniture inside the residence, only a few piec
es of clothing, shoes and trash scattered on the
floors throughout. The woman said she was
very concerned about the condition the resi
dence had been left in. Another deputy, who
lives in the same subdivision, said the house
had been abandoned for at least one month.
The inside of the residence reportedly smelled
like spoiled food and was left in a dirty condi
tion overall. The woman was advised the case
was a civil matter and explained the eviction
and abandoned property processes.
•shots fired at a Monroe Highway, Winder,
address. A woman called 911 requesting a
deputy after she said she heard two gun
shots in her neighborhood, but could not tell
if they came from her neighbor’s house or

Residents at a Dooley Town Road, Statham,
address called 911 after a 20-year-old man
accidentally shot himself in the foot with a .22
caliber magnum rifle at his girlfriend’s house.
When sheriff’s deputies arrived, the man was
lying on the front porch of the house while his
father kept a towel wrapped around the man’s
left foot applying pressure. The bleeding man
explained that he was going outside to shoot
a squirrel and took his gun off safety. He said
he was walking out of the front door with the
barrel of the gun pointed towards the ground
and he accidentally touched the trigger. He said
when the gun fired the bullet struck him in the
top of his left foot. His girlfriend was at the
front door of the residence and ran outside. She
dialed 911 after he told her he began to feel like
he was going to pass out. The man laid down
on the porch and called his father who lives on
the same road. Both the man’s girlfriend and his
father recounted the same story. Once his father
arrived, he elevated his foot and began applying
pressure to the wound with a towel. A medi
cal unit arrived and took the man to the Athens
Regional Medical Center where he was treated
for the wound.
Dispute between friend and
ex-wife summons authorities
A dispute at a Dooley Town Road, Statham,
residence between a man's friend and his ex-
wife resulted in authorities coming to the home.
A Carl-Bethlehem Road man said he called 911
after his friend’s ex-wife told him if she heard
him swear again, she was going to beat him up.
The man said he was visiting his friend at his
Statham residence and drinking beer, when his
friend's ex-wife decided to visit, as well. The
man said he and his friend’s ex-wife do not get
along at all. The man said sometime that night
he said a curse word and his friend’s ex-wife
got mad at him for swearing in the presence of
her granddaughter. The deputy asked the ex-wife
what happened. She said she comes to this house
often with her granddaughter so that she can
visit her grandfather. The woman said she is tired
of the man’s friend at the house drinking every
time she comes over. She said she kept hearing
him swear, so she asked him to be quiet or leave.
She said she never threatened to beat him up.
Both parties said there was no physical violence
made and the ex-wife said she would leave the
house in order to prevent further altercations.
Authorities told both parties to leave each other
alone if they know they can't get along. The
woman reportedly did get in her car and leave
the home without incident.
A sheriff's deputy reported a pedestrian under
the influence on Atlanta Highway near Auburn was
let go by a Carl police officer. Officials were dis
patched to the area near the Oasis Bar on Atlanta
Highway in reference to an accident between a per
son on a bicycle and a car. While en route, a Carl
police officer reported he was with the person on
the bicycle, a Parker Road, Auburn, man. The Carl
police officer checked the cyclist for warrants. He
was not wanted. The man also refused a medical
unit and was released. The sheriff’s deputies met
with the Carl police officer at the BP gas station in
Carl. The Carl officer said the pedestrian showed
no signs of being struck by a car, but probably
fell over because he was intoxicated. The sheriff’s
deputy asked the Carl officer where the pedestrian
went. The officer said toward his home on Parker
Road. He described the man as white with spiked
hair who was wearing a backpack. The deputies
located the man and asked him what happened.
The man said he fell over while walking beside his
bicycle. The man asked the deputy if he could have
a ride home. The deputy said there was no way he
could transport his bicycle and told the man to get a
ride from a friend. The man asked if he could walk
home. The deputy said if he's found walking on the
side of the road intoxicated, he could be arrested
for pedestrian under the influence.
Man calls 911 to report
child abuse for son’s shaved hair
Authorities responded to a Lois Kinney Road,
Statham, residence after a 60-year-old man dialed
911 and screamed child abuse into the phone and
then hung up. The man told police he dialed 911
because his stepson shaved a juvenile's hair and that
was child abuse. The man said he did not approve
of it and a child should not be treated that way.
A responding deputy told the man that shaving or
cutting a child’s hair short is not considered child
abuse and if he does not approve of how his step
son is raising the child, he should contact DFACS.
The deputy then met with the man’s stepson, who
explained he was giving the juvenile a hair cut and
the juvenile bounced up out of the chair, causing
the clippers to cut too much hair. The man said he
cut the rest of the juvenile’s hair short so that the
child would not “look silly.” The man said the child
belonged to his girlfriend, who was incarcerated
in Towns County until the day of the incident. The
deputy was able to contact the mother’s sister, the
child’s guardian, who said she already knew what
happened. The mother was next to the sister, and
confirmed that the boy’s stepfather had permission
to keep the child. Nothing else from the incident
was in the report.
