eral Gsrdon and Mr. Stephens were the
leading candidates throughout the eon-

the two last ballots: and even in the last
ballot, while members wore changing
their Vbiea, it seemed difficult to tell
who would be the successful candidate,

In the election of Gen. Gordon, the

A case of considerable importance has
jnst been decided in the United Htab s
Circuit Court iu Equity—that of William
C. Bonn, assignee in beukrnptcy, against
Louis E. Amsinck and others. The
action was a bill in equity brought by
William C. Bean, assignee in bankrupt
ojol Charles B. Kintzing, ot St. Louis,
Mo., to recover the sum of 810,275 83
from tho defendat Is. It is alleged that
Kintzing A Oo, became insolvent on tho
fourteenth day ol February, I860, and
that a compromise waa made, dated the
fifteenth day of Febrnary, 1809, by which
the creditors were to accept 70 per cent,
in three equal pejmetito at six, twelve,
and eighteen mouths, with intorest, for
which tho notes of the insolvent firm
were to bo given. Tho insolvent
firm owod the defendants at the
date of the compromise the sum of
882,501 05, and the defendants signed
to compromise agreement in common
with tho most of the other creditors of
Kintzing A Co., but with the seoret un
derstanding that Kintzing A Co. were to
discount their compromise notes far an
amonnt equal to 00 por oent. in cash of
the indebtedness of Kintzing A Oo. to
defendants, upon defendants signing the
oompromiso agreement, and which was
done. Judge Blaobford decided that in
nil compromises of this naturo between
creditors tbero must bo open and fair
dealing, and that no snoh seoret under
standing ns was had in this eoso will be
upheld either in law or equity; that the
assignee in bankruptcy, as representing
all the ereditois, can maintain a suit to
reoover money so paid, under section 14
of the Bankruptcy act, and that the com
plainant must have judgment for the full
amonnt for which the notion is brought,
